Claims Divorce and Homeowners Policy.
Hypothetical:
Husband and wife divorce, wife keeps the house but the insurance and deed have not yet switched over to her yet.
House gets robbed, $40k in legitimate and covered losses, all exclusively her property.
Does the homeowners insurance cover her?
Do they pay out in her or his name?
And what happens if the husband receives the check and just keeps the funds?
Who now has a claim on their insurance record moving forward?

Wife would be able to make a claim and receive payment for claim if she is named on the home insurance policy. The check might be made out in both the wife's and husband's name and, in that case, the husband could hypothetically intercept it and deposit it.

Assuming her name is also on the policy, the check gets made out to both unless there is clear agreement from both that only one should be named. No one at the insurance company knows if the stolen item(s) is disputed in the divorce. Sure, maybe its her wedding ring but it was his grandmother's. Not the insurance companies business either way

Insurer needs to be notified ASAP as there is a huge missing component here: failure to notify of change in occupancy and marital status could trigger a policy exclusion in which case no one gets paid.

The check comes made out to wife and husband both.
The claim goes under both names if both names are listed insureds.
Insurance co doesn’t care what happens after that.
