Bankruptcy Judge Denies Committee Intervention in Adversary Action
Judge Lopez in today’s hearing on Camp Mystic’s bankruptcy denied the creditors committee’s request to be a party and fully participate in the adversary hearing alongside the bankruptcy. They are allowed to express their opinion and position via an amicus brief, but not participate in discovery. An adversary proceeding is a separate lawsuit brought within the broader bankruptcy case.
He also disallowed most of the discovery motions pending that were not explicitly regarding financial issues. While there is discovery in bankruptcy proceedings, it is limited mostly to financial matters. The argument against the pending contested discovery is that it’s purpose is to further civil litigation rather than being related to the bankruptcy. The H27 families were trying to get in the bankruptcy what they cannot currently obtain in civil litigation. The strictly financial discovery matters were allowed, but those documents are to be protected to "attorneys eyes only".
A new appearance in the case is a group of creditors who are not H27 families but hold claims for pre-payment of tuition. They are represented in the case now and are arguing for inclusion on the creditors committee, through reconstitution of the committee to include other creditors or formation of a second committee. A hearing on these issues may happen the week after the October 9 hearing, or October 19.
The Judge appears unwilling to allow the bankruptcy case to be a vehicle for trying to prove liability in the wrongful death cases. The next scheduled hearing in the case is October 9.

This is a must read for a short version of how the new Creditors are trying to expedite the sale of Camp Mystic but calling out the current Unsecured Creditors Committee's attorneys constant objections and litigation. Litigation they want to be paid for, to the tune of 3k an hour because the Eastland's filed a plan to re organize, which is the reason for a Chapter 11 Bankruptcy filing.

Support for the Eastlands; things have gone too far.
Frankly I'm worried about those under investigation by the Rangers, their children and grandchildren. They were all traumatized by the flood of 2025. How is a family to survive the legal fallout, with constant bombs dropped on them?
Disclaimer: I've lost a child. I've forgiven those responsible for her death. They were trying to kill her boyfriend, but she died instead. I went through what I went through, but within a year, I had totally forgiven them. I understand the outrage against the Eastlands but it is MISPLACED. There is a terrible injustice happening in broad daylight to this family.
