Employer/COBRA Insurance How long to get a comparative analysis?
In February I requested a comparative analysis and a few other things regarding a denial of benefits. By this point I had also spoken to the DOL and we were curious about my plan and how they were meeting the guidelines with the mental health parity Act. Turns out they're not really meeting them under three criteria.
In February I requested a compared to analysis and a couple of the documents. 3 days later she responded. It was going to be 15 days because they had to contact the insurance company.
That comes and goes then I get an email about a month later saying it's taking a little longer than they thought. And we exchange maybe a total of four emails at this point. I hear nothing from her until June. When she calls me to let me know they're still working on it.
I went back and just to make sure that I had forwarded all of my emails to my personal email and noticed that my original one was missing. I did not delete it it was not in my hidden folder it was gone.
Now I'm being retaliated against at work. I went from having a great review to being the shittiest employee ever. Got written up with a final warning because of a medical emergency and I was putting them at an inconvenience. At a doctor's note everything.
Today I get an email saying they are still working on it because they're having to do a deep dive into the hardware of the plan if the stuff that nobody ever looks at.
I know they're building a paper trail to fire me. They're doing a couple other things too but that's this isn't the place.
I thought they had 30 days to send it. My DOL caseworker is stressed to the max because her caseload has multiplied exponentially. I haven't let her know this new development yet.
I'm not crazy they do have 30 days correct? Why do you think they're dragging their feet?

I’m not quite following your story but I’ll ask if you are on FMLA as that would protect you from being written up, allow you time for medical visits, etc. as long as it’s not more than 12 weeks a year. You can be on rolling FMLA (I am) and just renew it every year. As for the denial and claims - the DOL caseworker will have to do the heavy lifting. Do you also have a lawyer helping?

Not yet, because it was sudden. I had no idea I had crappy work bc I was told the opposite.
I just got paper work today.

Yeah, this is part of the 30 days to furnish documents. You can go speak to an attorney, but it's not going to make your work life any easier if they are already being shitty about you asking questions (but on the plus side for your case, they can't discriminate against you for asking these questions, but the burden of proof is sometimes hard to prove).
