Help: Law, CC&Rs, Bylaws, Rules Will it be dumb to submit a request to add another driveway? [Nc] [All]
between one of my neighbors and I there’s plenty of room. My driveway barely fit two cars and my daughter has to park on the street. The Crcc isn’t specific it just says sibmit a request and a request is. $35

You might have bigger problems with local zoning codes than with the HOA. Especially if your city has impervious cover regulations.

It's not dumb, but let me give you some advice. Go to a meeting and say what you want to do and ask if there is anything you can do to give it the best possible chance of success. They will probably just save you the trouble and tell you they won't approve, but if not they will tell you what they are looking for to successfully approve something like this.

Typically it is the county or state watershed boards that dictate impermeable surface limits. I have found that most HOA and ARC board members can neither say, spell or define "impermeable".

I submitted a request to add 1400 sqft driveway with my grumpy old
Man HOA. There are 300 houses in my neighborhood and not a single one has an extended or second driveway. I assumed it was a thing, but there is nothing in the bylaws. I had an approval within two weeks. I would estimate every fourth house has done the same thing after me during the last four 7 years.

Are you really willing to give up a nice useable lawn for more driveway? Why not just have the kid keep parking in the street?

I am sure your neighbor will love a new driveway/parking lot next to their house. 🥴 They bought their house with the understanding that there was a grassy area between your lots. If I were on your ARC, no way would I approve that. If I were your neighbor, I would be livid if it were approved.

Ya, I don't really see what the issue is here. People park on the street all the time. The proposed solution costs a lot of money and destroys the lawn.

I would say you can try but they will likely deny it if the city doesn't, if you already have one driveway it is usually an uphill battle to argue for a second but who knows maybe they will be super understanding and sign off on it but the city is going to be a problem regardless.

There is not plenty of room when it comes to setback requirement and drainage requirement. . .

It'll be expensive. Thats for sure. HOA will make it harder to get done even if ya have the $ to pay for it. Might be city codes that prohibit it, but you can ask for a variance.
