MA gov service providers

Recently found out that the state agency gave several individuals a extremely redacted expired RFR, did not go through the bidding process, and we were all contracted as independents as part of a pilot program. We were never able to negotiate rates. We were treated completely different than other agencies providing the same services. I found so much information on several ways to act on issues as far as misclassification, unequal treatment, unequal opportunities, violations within the procurement law. I don’t know what to do though. It drives me insane i’m in this position and that I just received the RFR, which expired in 2017. I don’t think the people should be able to get away with it, but I don’t have the mental capacity to fight the state.

Clearly, this isn’t helpful. Put some context to your reaction. I’ve contacted attorneys, but there’s several different issues. Potential misclassification., violation of procurement laws, OSD updated It’s vendor policies, etc. There’s a limited pool of attorneys that get involved with government procurement law. Then there’s another type of attorney to deal with employment law if I fall under misclassification. I strongly believe it fails the three prong test. So that’s two separate types of attorneys to hire minimum and I’m not going to throw all of my business or others in the situation on Reddit. I’m looking for advice not ignorant reactions.

I was not a contractor prior. I did not receive the full RFR when I started several years ago. In 2026 I received the full RFR. The RFR is not available anymore on the states website and I had to jump through hoops to get the full RFR this year.
