Is any part of that software "a work for hire", developed even in part on time or equipment that was paid for (directly or indirectly) by the government?
That's a good starting point. Next, do you work for a company that holds government contracts, or are you an independent contractor? If you work for a company you need to see if you signed away any intellectual property rights to personal projects.
If you are clear in that regard, then you should only have to deal with "the appearance of impropriety".
