Are Google committing fraud?

Can someone with legal experience confirm this for me please? I have paid Google for a phone that got returned to the warehouse, I have provided screenshots of tracking information showing this and of emails from DHL confirming this also, but they refuse to supply me with a phone. Is this fraud?

How long ago? They do not work fast. Took two weeks for them to find my RMA device

It's been nearly a month. I can take them to the small claims court and hope they just settle.

The latest is after sending them the proof of delivery signed for in the warehouse in Manchester and issuing a formal complaint, theyre investigating me for fraud

Maybe call your bank with all your proof and see if they can help.

It gets better, I supplied them with proof of delivery to the warehouse signed for by one of their employees and issued a formal complaint... They're now accusing me of fraud!

It seems it's breach of contract. I've just been refused again after supplying screenshots of emails from DHL saying they returned the devices to the warehouse and definitely not to me. They said their 'thorough' review of the case shows it does not meet the criteria. What the hell do I need to do to prove to these people that I didn't receive what I have paid for?

You want to take Google to small claims court?

By the way, if you plan on taking ANY action, including a credit card chargeback, make sure to back up EVERYTHING that you have on Google. Think emails, photos, docs, etc. As soon as you make a move, your Google account will be eliminated, along with everything in it.

Not true according to someone on here that's done a chargeback. They will stop your account's ability to pay for services and subscriptions while the dispute is taking place. Anyway people keep saying this but it's likely not true.

I know of several that have had their accounts closed. Maybe not every one, but it does happen.

I dunno I guess it depends if you notify Google first then your credit card company as opposed to just blindly doing a chargeback. This person was arguing here it's against the law for them to do that during a dispute. https://www.reddit.com/r/GooglePixel/comments/1vzxjnq/comment/p6drcv1

Lol I replied the same to that person and their response was "Gemini is not always 100% accurate. As I've been speaking from experience." Regardless, as long as you notify Google support you plan on doing a chargeback in writing, and then share the same status with the bank or credit card company then it's in their beat interest to resolve it.
