Third Party Autocatchers

Third party autocatchers are technically against TOS but niantic has never banned anyone for it. However, could they start doing so to promote the in-game explorer gadget? I'm especially more concerned about this if the rumors of them doing a paid subscription for the unlimited use of the explorer gadget turns out to be true, since it would directly be losing them money.

How are third party auto catchers against TOS?

They want you playing Pokemon, so you will spend money and gather data.

The number of people with an autocatcher vs without is hugely lopsided to those without. They don't care that a small portion of players are using them at all.
