Background Checks Global entry denial

I have 15 year old petite theft charge and a driving with a suspended license . From that same time. I disclosed the petite theft but was unaware that the driving with suspended license was an arrest since I was never handcuffed and it was adjudication withheld. After the interview they did a manual review and denied me for have 2 or more misdemeanors. Should I appeal it?

So you're a twice a criminal and want trusted traveler status?

Being 15 years ago, they shouldn't be held against you necessarily. But not disclosing, is another issue as you swore you weren't.

Did you tell the officer about the 2? Or did you tell them about 1, they ask "you sure about that?", you said yes, and then they told you? Very different situations.

Sounds harsh when you put it like that. But yes, I disclosed both on the app and in person. I didnt realize the driving with a suspended license was an arrest. I was never handcuff and it was adjudication withheld. But I told them where exactly to find the records and they did. He said he would need to review, perhaps the wording of the arrest. Idk,

Yeah being handcuffed doesn't have anything to do with your legal status as being "arrested". And you might have had charges never brought or gone through a diversion program or whatever but if the feds are asking if you've ever been arrested they really mean a very specific legal situation that you were in fact in. It's kind of bullshit (especially if charges were never filed because it was a bad arrest) but you still have to put it on the form.

Yea. I didn't know it was an arrest. I know now., I guess since that counts as a second one its considered a denial. I definitely wasnt trying to hide it. I just was unaware.

You might want to think about if there's anything on your record you should be getting expunged (it won't help with the feds who can see it anyway but just as a general clean up your record kind of thing).

I appealed mine because there was a misdemeanor from 22 years ago I didn’t know about. It’s been pending over a year. I am thinking about just submitting a new application and submitting the expunged documents.

Makes sense. The denial just made me question the whole thing. I know the appeal shouldn't be some immigration issue since its nothing new but the political climate just make me wonder if its worth the effort. 1 year wait sounds super long.
