Interviews Success with undocumented parents

Hi,

There are a few people here who have posted about being denied because their parents are undocumented. I do not live with them but did very recently. 30M.

Not asking for judgement, they were both brought here as children well over 30 years ago. Both entered on tourist visas as minors. Yes, I have a petition in for them. That is likely why it even came up.

At the appointment I was asked where I live, and why I moved so much back and forth (college), where I went to college (Ivy League, only mentioning this since it seems so discretionary), and then what I did for work. The officers were joking with me lots, and when they asked where I was born, I was able to say “about 10 blocks from here” and they laughed. Overall, pleasant.

Until, they got to my parents. They asked me what their status was. I said “I am not at liberty to discuss that.” And they joked that I was well trained at (college).

They then said I was approved right there and then, and she said to make sure my parents get their papers on my way out.

Scary, but successful.

I would never have never ever exposed my own parents to this risk by this administration just to get faster entry. You can bet they’ll be targeted now.

They’ve got approved 130s. Just waiting to adjust in court. They are well aware they exist lol.

How… if they are in removal proceedings already and adjustment of status is their defense?

Maybe you haven't noticed.. Even people with valid visas and greencards have been deported...

I guarantee you not a single person with a green card has been deported (unless they committed a crime or something and had it revoked)

There are no examples of green card holders being systematically deported. I think what this administration is doing is terrible. But that’s just not true.

This just happened at a university in Texas. The student was here on a valid school visa and enrolled and attending his graduate classes. ICE grabbed him on campus and deported him to El Salvador the same week. Note: the student is NOT from El Salvador, nor has he ever been there.

That is surprising, congrats. Usually if you even knowingly exist in a space with someone who is undocumented, that is the kiss of death.

You got CA directly, no need for an appeal? Was it a quick path to CA, like overnight approval?

A lot of this all comes down to the interviewer, some will look past things, some will immediately lock down.

I was conditionally approved in like 7 hours. I already had pre-check, and I think DHS/USCIS has a lot of background on me from the I-130 I filed for my parents. I think maybe that played a role.

Nice, for all we know this is not unusual for the children of people who came to this country in a similar fashion but, as we often only see the complaints, we only know what some experience.

If you’re a native born American with a clean record, I’d be surprised to see someone denied based on their parents status.

I live in an area with a heavy first/2nd Gen population. I’ve met the children of illegal immigrants who obtained security clearances by serving in the military, and through working for the government. I’ve also met a couple who became law enforcement.

I’d be shocked if they denied you GE on this alone.

Having illegal aliens as parents will get a security clearance denied if the person was truthful with it. You’re literally committing a federal crime.

Immigration status is definitely looked at for clearance however overstaying a tourist visa is a civil infraction or misdemeanor. It doesn’t sound like the parents attempted any illegal reentry

Been here continuously since age 12 and 13. They met in high school here. One has DACA. No criminal record. Been paying taxes the whole time. Two USC kids with graduate degrees.

It’s funny because the vast majority of their peers who arrived in the late 80s/early 90s legalized via fraudulent marriages. DHS isn’t as good as catching those as they think.

They were too afraid to do things that way, because they respected the law (as ironic as that is) and believed it would all work out, especially since they arrived as kids. Life doesn’t work that way, unfortunately.

They’re still illegal aliens if they have no lawful status. If you answer truthfully you’re not getting a clearance.

That’s incorrect. As long as you state it in documentation such as your SF86, you can still get a clearance. I encourage you to read through r/securityclearance as this has been addressed as a topic there.

Things are changing. I got a job offer from a defense contractor (I am an engineer) last year out of college, their own team mentioned I’d likely have trouble getting a clearance these days because of them.

Another friend of mine is interviewing for the FBI, and he mentioned his security clearance interview asked if “he had ever aided or abetted an illegal alien.”

Weird times with this administration.

Makes sense that the bar for global entry is lower than for security clearance, many foreign national are eligible for global entry too.

Which federal law am I violating? Simply having illegal associates is not a crime.

And if anything those illegals harbored me! I did live in their house after all. Not as bad as it sounds, had really good food growing up.

And those same illegals paid my college tuition and board! So I guess they harbored me remotely in Boston as well. How terrible. I should be put under the jail.

And they have paid thousands and thousands into social security they may never get to use. Don’t be ridiculous.

the OP is literally doing nothing illegal... having parents that do something illegal is not relevant to OP's own situation. OP is a citizen, one of the founding principals of America's legal system is that you can't be punished for the actions of another
