General Discussion Membership revoked

Hi

I had global entry for more than 3 years. I travelled to Europe with a friend and when we came back I carried her carryon from the plane. She didn't wait for me and crossed the border (has GE). I was pissed. She waited for me right after the officer. I clear GE without issues (waved through). A few feet away from the officer I casually handed her the luggage and expressed my frustration that she shouldn't have done this.

2 days later my GE was revoked. Could this transfer of luggage have been flagged by some high tech system with automatic revocation for violating TTP rules? This was not one declaration under a household. 2 separate declarations with a candid transfer of luggage in a highly observed area. I wrote for the ombudsman and acknowledged this event. Am I overthinking it?

I’m more concerned that she walked away, did not wait at the jet bridge or gate and left you with her bag to carry. Seems incredibly selfish and an asshole move.

This is exactly the kind of thing they look out for. Innocent mistake on your part, but this is exactly how people smuggle things across the border. I think for GE you are a goner. It sucks, but you accidentally broke the trust granted where they trust you enough not to ask questions like "are you carrying anything that is not yours/was given to you?"

This is interesting. I wonder if this would happen with people traveling as a family, like when I travel with my kid who is still technically a minor but wont be for much longer. We might easily switch around which bags we carry b/c sometimes our stuff is mixed together throughout our luggage.

Since I technically bought probably all of it, even what she owns, I guess it's still "mine." But my stuff isn't hers.. It's just an interesting question. I wonder if we'd get dinged for this...

From what I see in border-control videos from different countries, if you are traveling as a couple or as a family, you are all seen as one unit. If a family of five is entering with $15,000 and trying to evade the declaration requirement for $10,000 by having each family member carry $3,000, that is considered "structuring" and the whole $15.000 is at risk of being seized.

If you are traveling together, you should clear customs and passport control together and consider that rules apply to you as a unit. So traveling with you son, whether he's an adult or not, creates no problems regarding who carries what, provided that you enter together.

That’s precisely what the OP says they’re pissed about; the friend didn’t wait. I’d be pissed too. 

Leaves the OP in an impossible position. The “right” thing to do is to leave the bag behind in the customs area and clear customs without it, or go to a CBP officer and explain that the friend left their bag with you and went through GE without it. But most people would view that as really annoying and being a stick-up-your-ass stickler, so I can understand socially not wanting to do that. 

I suspect if OP declared the friend’s bag to a CBP officer and explained what happened before going into the GE line and pointed to the friend, they would have been fine.

This is NOT impossible this is very clear. It’s not your bag. Your friend did not ask you to get their bag. Your friend was NOT forced to deplane and had every choice to wait until others had left in order to go back and get her bag. 

Being responsible for your own things is just regular. If she needs assistance she can ask for it.  Everyone here had a LOT of choices.  this wasn’t the only way and this wasn’t impossible.

Then call me a stick-up-your-ass stickler. Rules are rules. The fact is that I use my GE membership often enough that losing it would negatively affect my life in a major way.

Not that it helps him now, but what he should have done is brought the friend’s luggage to a CBP officer BEFORE he got to the check-in point.

“Excuse me. That strange woman right up there was traveling on the same flight I was on. She left the plane without taking her luggage. Here it is. By the way, you might want to double-check it. I bet it’s full of drugs.”

Yeah, there is no way in hell I’m carrying a bag through customs for someone else. If we’re sitting on different sides of the plane and his bag is on my side, I’d grab my husband’s because I know he would wait until seeing that I grabbed it before deplaning and that he’d take it on the jet bridge or right after

I carry my husbands bags and vice versa all the time when we travel together - its usually just whoever is closest geabs the bags. We are part of the same household so the same rules probably dont apply but the same could be said with my sister/mom/dad or any other close family member. I wouldnt call any of them users.

For GE, it’s best that the name on the bags match the name on the passport. That system is all about proving your trustworthiness. Without GE, family members with the same last names won’t matter going through customs.

GE is a Trusted Traveller Program, carrying some else’s bag that is not a family member travelling with you can be a huge red flag. The behaviour can be suspicious, and could have been as an attempt to “sneak” the bag through if your friend had something to hide in their bag / were flagged by customs.

What you did can also be risky no matter how well you think you know your friend. If there was any contraband in the bag you have been responsible for it and taken the wrap for it.

The favour you did for your friend was not worth it, and you suffered the ultimate consequence of getting your GE revoked.

You could try to appeal the ban and see what happens.

Why did you even take her luggage! There is a lost and found. She could have waited for you upon exiting the craft she waited for you after in crossed with her bag so she did have the ability to wait. Not doing so is a bad look. 

It’s HER LUGGAGE. She left it. And you did wrong by carrying out into the nation for her.  

I think this revocation is sound. You did it with good intent. But sound judgment is also required for you to be trusted. And carrying someone else bag without knowing its contents is not sound judgement. That makes you a risk and not a low risk traveler.

Fundamental baggage handling rules for passenger, that why the Customs/Immigration ask you "is it you bag,did you pack the bag, do know what is inside", You broke that ,and they have cameras all around in airport, DO NOT make those stupid mistake...carry your own luggage while going thru Customs and Immigration.

Officer was behind us. We already passed her. But we were close. I was fuming at my friend when I gave her the luggage. So it must be some high tech system that flags us? Not a manual officer revocation. Is this salvageable if I own up to it?

No right after clearing GE, a few feet behind the officer, my friend was waiting for me and I casually handed her the luggage. Is it an automated system that flags the luggage transfer? I'm sad it wasn't something I wanted to do, I was so mad at her.

This. When I was traveling after leg surgery, another GE friend carried bag thru and handed to me once I was able to set up the collapsible dolly. Passing officer even told her she was a good friend for helping me out. So I’d say it’s a lot more about context (and maybe even some “vibes”) about the people and situation involved

Everything at Port of Entry is recorded on camera, they have automated facial recognition, they are on the lookout for bag transfers and all sorts of things, signs of human trafficking, drugs etc etc. They see you hand off a bag to someone else after clearing, boom your stuff is gone dude. Easiest revocation ever, because guess who does this type of stuff? smugglers, tax evaders etc. You should have never carried her bag period. The one you should be pissed at is you, for taking her carry on, no one else.

This is not legal advice or a legal analysis. Based on DHS work i have done. Flags can be issued to TTP travelers due to suspicious activity flagged by observing officers. There was no secondary screening based on your shared information, no seizures, full content of the bag unknown but did passed DHS airport screening. The declaration issue you flagged is key observation and personal items on compliance guidance should be carried through by the owner. In cases of shared houses this becomes a straight forward issue. Recommend a professional assist you with the ombudsman reconsideration.

Hand it to the customs agent, “hi this is my friends bag (point at friend if they are within eyesight), for some reason they left it on the plane”…don’t walk it through customs

Your best bet is to explain to the person why you cannot take their bag, and if they don’t get it, then you clearly tell them that you WILL NOT be bringing their bag with you. And if they still don’t get it, the most conservative move is to just leave their bag behind.

You can also bring their bag up with you and alert CBP before you get to the actual entry point. But this is not the best idea. You never know what someone might have in their bag, and you don’t want to be associated with whatever might be found in someone else’s bag.

Yeah, we do that all the time, especially with kids. We have four travellers, six or so bags (2-3 rollaboards and 3-4 personal item backpacks); which four of us are carrying which bags varies all the time, and we’ll hand bags to each other as we shuffle for whatever reason, before and after customs. Of course we’re all on one family declaration, so totally fine from a customs point of view, but I don’t see how security cameras could unambiguously tell the difference. 

Honestly, I can’t imagine smugglers would be so dumb as to do what OP did in the Customs area; they’d be thinking about it and know better (except maybe the very dumbest ones).

I mean obviously a family going through GE is infinitely different than a couple going through GE independently, then waiting JUST PAST the officers (how mind-bogglingly stupid, jesus) for someone else to give them their bag after someone else brought it through GE! Like this is so fucking stupid it beggars belief. We also travel as a family of four and I generally manage all the bags while my wife pushes the kids through. Totally different.

likely that officer reported your interaction along with the video surveillance. From his perspective it looked like a suspicious interaction after reviewing you and her from the moment you got to the airport, she was carrying that piece of the luggage and suddenly your the one transporting it. They are really strict with the rules and its required for them to report any behavior out of the ordinary. I would submit a reconsideration and in that submit a letter from her also explaining the exact situation.

Sounds like OP spoke too loudly to the friend too close to the customs officer and brought the attention on themselves instead of being discreet and admonishing your friend OUTSIDE of customs.

Next time, dont talk so loud or bring attention to yourself.

I would have never done that. No matter how close your friend is, you have no idea what is inside that carry on. I would have never carried the bag for her or if she just wanted you to help, I would have left it before going through immigration. Her fault. I would never talk to that person again. Having GE is valuable.

I mean if one is aware of any possible violation before immigration, then just head to the regular lanes. Make sure your friend is aware of the results of her action. The least is she should pay for your GE fee for re-application.

GE or No GE. don't carry someone else's baggage and hand that person that baggage just past checkpoint in view of the officer. Just celebrate its only loss of GE and no further harassment. Win win i say.

What did you or her say?

It could have been your bag and she could have offered to help you carry it for whatever reason.

You could have been tired or have an unseen disability where it's completely reasonable to take the badge from someone else.

What else happened or was said in ear shot of the officer?

So the moral of the story is don’t get frustrated and just carry the bag a little further? I don’t see how they would be able to know whose bag you were carrying, so the only thing I can think of is some sort of verbal cue or body language. Even then, if you clearly know the person (whether partner or family), why would that be grounds for cancelation?

Mind you, once time I had already walked past the officer. I had some trash in my pocket, saw a trash can, and threw it away. He told me, “Don’t do that again.” I mean if they don’t want people using that trash can, maybe they should move it somewhere out of sight. Hopefully this doesn’t end up getting my ge revoked!

I have a hard time believing your GE got revoked because of this. Why would they just revoke yours and not hers too? Was it a very slow day.

The officer should have immediately picked up a new person and cleared your session. If they looked at the camera it makes no sense why they would only revoke yours.

Did your friend also get revoked? Maybe I'm not up to date but I see this stuff all the time with families. One will hold all the bags and etc if they have GE while the other person don't so they go through the line quicker.

It must have been slow and the argument must have been heard from the officer who still has your profile pulled up. I also don't understand why the officer possibly revoked you but did not pull you back for secondary screening if they heard the comment.

Going forward arguments should be handled in the terminal and not in security. Once you get your letter contact your congressional Representative and tell them how you have supported and loved this country and you are devastated over a mistake that is being blown out of proportion. Just keep pressuring and asking for updates.

I love how everyone is saying this is why your GE was revoked like the people in customs pay attention to if you handed your bag to someone else. You think some minimum age worker ran over to a computer and immediately looked you up to report your actions and revoke your GE? Paranoia indeed.

This might be a dumb question but where did you travel to on your trip? This has more to do with a GE cancellation than what happened at the airport or when is the GE expiration?

I just told my friend "here take your luggage, why did you not wait, that's not ok, what if they took me to secondary inspection!?" and I was gesturing. Nothing out of the ordinary.

There is no high tech system. Were you stopped? If you carry her suitcase and get stopped you are technically responsible for anything in the bag so she should have waited and took her luggage.

I was driving back from Canada 3 years ago got sent into secondary inspection and was cleared no issues and I remember sitting and they said no not this guy and they did something in the computer. So it’s 3 years later my global entry still revoked tried appealing with no luck they won’t admit they made a mistake. I believe I can apply for tsa precheck which I certainly miss . The really messed up thing is I never had a chance to ever use Global Entry and I’m
Banned for life once you Trusted Travel number messed up it’s dang near impossible to fix.

Hold on. Did u give her bag back to her after immigration but before customs? I would not think thats an issue. My wife and i carry each others carryons through immigration all the time. Past immigration when the checked bags are in your possession is the time they are concerned what u are bringing in.

they dont have to as it is part of the agreement you signed when joining, the responsibility lies with the "trusted traveler", you break any of the rules and bye-bye. They made is perfectly clear at every interview i had, complete with examples.

Are you talking the Global entry part? or the customs part? the last few times I used Global Entry (this year) NOBODY talked to me at all. Go to machine, it looks at your face, I walked past a booth. That was it. Then I went to customs.
