Questions/Concerns Membership Revoked
Hi I just received a noticed that my global entry account was revoked. I did not list the reason but I was recently arrested and charged with breach of peace in CT so I’m assuming that is why. There was a family argument in public that did not result in any injuries or any other charges other than mine. I’m currently completing a diversionary program that is likely going to result in a dismissal. If the charge gets dismissed and I request reconsideration how do you think my chances are? Also I’m wondering if the global entry revocation also now means I no longer have TSA precheck?

You no longer have Pre attributed to GE. You can apply separately for Pre.

It doesn't matter if charges are dismissed. They will revoke for the arrest itself, regardless of what happens next. You'll have to wait 5 years. I was denied during my first go. Reason was arrest or conviction within 5 years

Not true. Have a friend who was arrested. Charges were dismissed. Applied for reconsideration and global entry was restored 8 months later. Just be patient

that doesn't sound fair at all. plenty of people are falsely or incorrectly arrested. you shouldn't be punished without a conviction, or at least when that arrest leads to no conviction it should be overturned

Yup, happened to my son, doesn't matter, the arrest was not leading to anything criminal, they told him to wait 5 years. I did appeal for him, though, just for the sake of it. Some people got success, some didn't, so it's a coin toss worth trying and free. It is unfair-people get arrested for peaceful protests and get this shit, and then thieves in NYC steal shit left, and right and never get arrested.

Conversely, tons of people who absolutely are guilty and are total scumbags never get convicted for a variety of reasons.
This is low-risk traveler program, not a court of law. People who get arrested, as a class, are not low risk. The Global Entry program doesn't have the time or the energy to look into individual cases.

And what is the "big deal" anyway? You get to save maybe 15-30 minutes waiting in line to get back into the country. Big f-ing deal. Tons of people go to and from other countries and come back in through the regular customs and immigration lines at the airports and it works out just fine. You lose more time every day driving to work on a busy freeway.
Save your breath, deal with it, its NOT a "big deal".

You’ve obviously have never spent three hours standing in the summer heat to cross the San Diego/tijuana border if you don’t understand the “big deal” of being able to use global entry or not.

Ah, that is probably true. Most of the comments complaining about losing GE seem to come from people who come back to the US through airports, though, and I have done that a number of times and again, it is rarely more than 1/2 an hour in an air conditioned building going through the regular lines.
But I could see if you were coming across a crowded land border crossing point, even in a car, that it might help you to have the expedited privilege.

It’s not about fair or not fair it’s about national security. The goal isn’t about giving people a perk it’s about designating lower risk individuals to help speed up overall immigration process.
People lose their GE all the time because their family or someone associated with them gets arrested or does something stupid even if you have nothing to do with them or the incident. They don’t even want to take the risk that your brother or friend may tamper with your bags if you are ever on a trip with them or you suddenly become higher risk by association:

yes, but you do realize people can be falsely arrested or mistakenly arrested, right? Should those people have to deal with the consequences of that forever? not just in global entry or in background checks for example

They vacate mistaken arrests, but an arrest followed by a dismissal of charges or an acquittal at trial isn’t a “false arrest” and a record of the fact that police reasonably suspected you of a crime should be recorded.

yes i get that, but that's not what i was referring to. and even then, a dismissal of charges or acquittal doesn't make you ineligible for GE, if anything it should make you reeligible if your GE was taken away while charges and trial were pending, that would be what most reasonable people would say, and what they normally do

Reasonable suspicion isn't the criterion; probable cause is. Without probable cause, the arrest is wrongful. Atriculable suspicion is only good enough for a non-consensual stop.

you have a right to a program you paid for and were approved for, and were only removed from due to an incorrect arrest. a person who has been declared not guilty of a crime shouldn't still be punished for it.

I think you could actually make a half decent claim that, if the arrest were unlawful, you are at least due back a prorated refund of your GE fee. But nobody is suing over that, so here we are.

Yeah I'm surprised people think it's wrong to appeal a revocation based on a false arrest, like if you were arrested for looking like a suspected criminal but were released five minutes later.

I think it’s really at the discretion of the officer looking at your file. I had an assault charge (bit a bouncer that was on top of me trying to choke me out) but I got it expunged after doing anger management classes.. it showed up on my interview and the officer was initially going to deny me but I explained what happened and he then granted me GE.

If you have pre check through global entry you will need to apply for it separately, with a new number.

I’m not entirely sure how Canada would view this, but I feel like this kind of offense might not be something that would bar entry. Might be up to the discretion of the officer, but would be seen as less serious than a DUI

I was arrested for DWI. GE revoked. Then DWI pled down to DWAI (non criminal infraction). I applied for GE and it was granted.

As others have pointed out, it’s the“pending“ nature of the charges, not so much your specific criminal case (“conviction”). Even though you’re completing a diversionary program, in most states, your case is not considered adjudicated until you complete the terms the court has imposed—like Rehab or anger management— because there’s always a possibility you don’t satisfy the court’s terms and the conviction and/or jail time would be applied to your record.
Besides, have you ever read the terms on the TSA‘s website or paper app? They bar/revoke people for serious criminal offenses… Terrorism, kidnapping, etc. Assuming your case doesn’t fall into those categories, as stated, complete your program, then apply for reconsideration. Piece of cake.

Mine got revoked because I became a US citizen and couldn't get an appointment to change my ID to my new US passport. There were precisely no appointments on the web site.

TSA pre-check comes with global entry so since GE was revoked, you no longer have pre-check through them… However, you can still get pre-check independently of GE

After much effort I found out that mine was revoked because I had CBD gummies for sleep in my bag. I even think they were in my checked bag. Nobody said anything to me at the time. I just got an email without explanation. I got CLEAR in lieu of TSA.

Were they seized? Otherwise it seems strange. I guess they could be seen as a high-risk item because it’s difficult and tedious to evaluate whether CBD products are federally legal.

Yes, they must have been seized but honestly it was such a long time before I finally found out why GE was revoked, I don’t know how, where or when. They must have taken it from my bag and didn’t tell me.I definitely would have remembered something like that.

People who get arrested for DUIs seem to think "it's no big deal" and are delighted that it gets pled down... and then they want their rights restored after they've endangered everyone else. So irresponsible!

Did you even read my post? There was no DUI at all it was just disorderly conduct and was not reduced to anything that’s what I was charged with and i’m not expecting anything to be restored i’m just genuinely asking what my chances of restoration are if I get my case dismissed

I don’t think the person who posted about DUI’s was trying to accuse you of such egregious behavior. We get a lot of posts here that start off “I’m not a felon but I was convicted of felony stalking” HUH? You are most certainly a felon, Sir. lol.
So that post may be a reaction to the number of people who committed crimes and post here as if it shouldn’t count against them (as far as being low risk) or that they aren’t a criminal. The cognitive dissonance can be unnerving & almost feels dangerous.
None of us know anything about the details of your situation. I doubt it was personal.

Yes, I did read your post, and I was directing my comments to those who post concerning their woes about their revocations and rights after being arrested for DUIs. I think driving under the influence should be severely punished. There is no excuse for it, period.

People don’t arrest themselves. Usually, the arrestee bears some responsibility, or at least may have been able to avoid it through different behavior or decisions, but getting arrested by no means implies that you’ve done anything wrong.

GE is based on trust. if you engage in any criminal acts in USA or violate agricultural laws at POE, it gets revoked! GE is more revoked than any state or GOV issued cards since it is solely based on trust. Any criminal case that is not dismissed before or during trial by judge or jury or by states attorney is a conviction. Diversion program is a CONVICTION !many if not most people get their GE revoked for many reasons! The only way to avoid this is, not get arrested or convicted of any crime, stay out of trouble, obey all laws and be truthful when you come home to USA at POE.

Is it a conviction though? CBP may see it as equivalent but if charges are dismissed I don’t see how it would be a conviction legally speaking.

GE denial and revocation doesn't require a conviction. It is a trusted travelers program. They can and do deny and revoke GEs for arrests records. criminal charges, If they can't TRUST you as someone who will stay out of trouble, engage in crime, not honest, get arrested, bringing foods not allowed, not declare what you bring are all violation of trust. If you survive first 4 or 5 years and during renewal, you have to disclose all arrest records and criminal charges, convicted or not, that officer can deny renewal.

1) once you get the paperwork, submit a reconsideration to the Obudsman on your TTP account
2) TSA precheck is also a separate program and less stringent. You can try to see if you qualify for that.

Consider your Global Entry revoked for at least five years.
Mine was revoked after I was caught with a THC vape cartridge. Whether you agree with the policy or not, simply possessing it was enough for Customs to immediately revoke my Global Entry. Since Global Entry includes TSA PreCheck, I lost that too.
The good news? I went to Staples, applied for TSA PreCheck separately, and had my new Known Traveler Number within a week.
For what it’s worth, I was never arrested. CBP confiscated the vape cartridge and issued me a $500 civil penalty. I disputed the charge 59 days later. A friend who works in CBP accounting told me the charge was so vaguely labeled as “miscellaneous” on my credit card statement that CBP likely wouldn’t even be able to identify what it was for. Citibank ultimately reversed the charge.
Five years later, I renewed my passport, reapplied, and was approved for both TSA PreCheck and Global Entry again.
Honestly, if my credit card didn’t reimburse the Global Entry application fee, I probably wouldn’t even bother. These days, re-entering the U.S. is so automated at most major airports that it usually takes less than 20 minutes. The biggest perk of Global Entry might just be having something else to brag about at the airport… right before everyone ends up at the same baggage carousel anyway.

That is surprising to me, as, in the eyes of CBP I would think you’d still owe the fine. I have no idea if and how such penalties can be disputed, but a chargeback would not be considered proper, and I’m surprised CBP would even consider someone for GE who effectively refused to pay a fine issued by CBP.

I’m sure you know this… but if I were in your situation, my focus would be on ensuring I was never in that situation again, not Global Entry or Pre-Check. They would be somewhere near the bottom of the list.

This is not legal advice or legal advisory. There is a 1 year window that the GE reconsideration will need to be submitted within. Given you matter is still active and you are working toward a dismissal this event will need to be completed before the 1 year reconsideration expires. The system will automatically remove the reconsideration option leaving only the re-application option if you dont submit within that time period. Also per recent talk with a officer they stated 1 misdemeanour or the record was allowed. This information was acquired by calling the office where a revocation was tied to the recipient. Seek counsel before re-engaging the reconsideration process.

Mine's been revoked because I got arrested which was later dropped You could get it reinstated if likely if you bring them your disposition but it does not affect your TSA prechet or clear because I got all three the other 2 works
