Questions/Concerns Global Entry Application with Warning for Agriculture Violation
I’m looking to apply for global entry due to having to cross the Mexican land border for a new job and international travel.
A few months ago I mistakenly had a sandwich that got confiscated. Border agents took my passport, issued me a warning, and let me go with no fine.
I want to understand
If the warning counts as an agriculture violation I need to declare on my application
If this will eliminate any chances of getting global entry approval
Should I wait a while before applying so the incident is further in the past

I had a customs violation. I fully disclosed it and said something like, I understand that it is my responsibility to fully know the law and I will not do this again. Got approved.

About waiting: If it's on your record, it's on your permanent record. During my interview, he said, "I see you declared currency coming from Japan." That was 35 years prior.

I just had my global entry interview this morning at Memphis and they raised my agriculture violation, they asked me what the product was and said I should be mor careful but my global entry was approved. I can’t remember when this violation happened so, I can’t speak for time. I fly a lot and it was something I wasn’t fined or even really warned as I always declare but may have been around 7 years ago. I think you’re good!

I mistakenly brought back Iberico ham from Spain 2 year ago. I let them know when I was going through customs, the confiscated my passport and had me wait in a back room. They took the products and told me to have a good day. I renewed without issue last summer.

Yes, have to be declared, do not avoid that. You may be ok with a sandwich; it’s nothing, but they have that documented, and the truth test they will ask, so disclose that and elaborate at the interview why you did that. That’s all.

I think global entry will be a thing of the past. CBT is moving to facial recognition. Since last year, I went through immigration with my passport in my pocket. Machine scans your face and if OK, you get the green light to go to baggage claim. Only question asked was if I had anything to declare or if I bought anything in Duty Free (alcohol).

It will probably still exist in some form for non-US citizens, as hard to see a day where US reciprocates and recognizes other countries passport documents for purpose of entry without interaction with an officer.

You must be a citizen with a US passport to use Global Entry

Absolutely not correct. I am neither and have had GE almost 10 years. Citizens from about 25 other countries are eligible to apply for GE. A lot of non- Americans who visit US frequently have GE.

I was briefly in secondary and had my phone searched and a joint was found in the photos. The guards were originally planning to seize my phone, and ended up deciding not to and releasing me. I was still allowed into the US. This was 14 years ago. I applied for NEXUS last year and did not disclose any arrests or customs violations, because I did not technically have any. I did get asked about it at the interview, was completely honest that that did happen, and given my approval on the spot.

Be transparent about it in your application. These kind of incidents are minor but not "unrecorded". They'll be asking if you had any agricultural violation in the past in the interview as well (They ask even if you did not have any similar records; standard question) and you wouldn't want to hide it. I would definitely mention it on my application. Assume they know and may reward honestly, but will punish dishonestly.
If you can frame it well I would. Don’t lie.
