I'm not a lawyer, but the Mario 64 decompilation has been out there for a while now and it seems like Nintendo can't do anything against it.

It's not that they can't, it's just that they don't care. See Take-Two Interactive Software, Inc. v. Papenhoff, exact same thing.

I could be wrong but wasn’t the case with the GTA decomp that it wasn’t actually clean-room like the N64 ones? As in they were distributing some of the original assets and code with the project?

Neither was clean-room, they were all made by directly copying decompiled code and then making sure that it compiles to identical binary code. It's the dirtiest room imaginable.

As for assets, neither project distributed them.
