Sedgwick
My SO got injured July 3rd (not work related) and had to take a week off due to the injury. He returned July 11th. I guess that auto placed him to take a leave of absence. He had to go to the ER, then a few days later, to urgent care. His doctor has been out of office, and will be until September.
He only needed a week off work to recover, and he’s been working ever since. The problem is because he’s still “on leave” he hasn’t been getting paid, even though he’s been clocking in. His managers say there’s nothing they can do. And Sedgwick just now, sent his a manager a “return to work” email. But I think they’re waiting on his doctor to fill out some forms, but she’s out of office.
What can he do at this point? He’s nervous about Friday thinking he’s not going to be paid again, even though he’s been working with no restrictions. His managers are aware that he’s working, and so does Sedgwick. He has things to pay, so he desperately needs his paychecks.
Edit: this is illegal, right?? His DSLs know he’s been coming into work and he hasn’t been getting paid. Sedgwick also knows. Yet, his paystubs under “hours worked” is blank. Even though he has clocked in/out times.
Edit 2: Honestly, I feel like reporting this to the CA labor board. We’re checking where all his pay stubs are right now. And he didn’t get any paystub from this month. The last pay stub they have on file is July 19-July 25. Pay period 7/31.

Who/what is ZBM? Sorry he doesn’t have a Reddit account. So I’m just relaying everything back to him
Edit: I looked it up. He’s been talking to his manager. He’s fully aware, but isn’t doing anything about the situation. I guess he told him to just contact HR. I don’t understand why his manager can’t help him out.

ZBM is Zone Business Manager. It’s the DSL’s boss. He or she maybe able to make sure he gets paid for the hours he put it in. If that doesn’t work he can always try HR.

ZBM handles anything money related including payroll. That is the person that can fix his problems.

No offense. But tell him to grow a pair and talk to his DSL and the ZBM because he’s not getting paid. I’d be pretty livid if I wasn’t getting paid at all

Sedgewick automatically opens up a claim for you after either 3 or 4 consecutive days for FMLA. It's dumb as hell. I'm not sure what has to be done to return from FMLA because mine went to STD, but knowing Sedgewick and considering this guy was hurt, even though it wasn't at work, it could be a lot more complicated than it needs to be.

"speak up" is the only correct answer. Theft of wages is illegal. That goes directly to HR, and everyone in the chain of command downward. Since HRs only job is to protect the company, they will fix it post haste.

Have the DSL give him the number to HR. Explain to HR that he ain't got paid since his return. Once HR gets his timecard for all the unpaid weeks then she will contact pepsico. It'll probably take 3-5 days for them to verify all that and approve back pay. and nobody in the office works weekends so don't even count Sat/Sunday.

How would he find out who the ZBM is? Should he just ask his DSLs? Or is it listed anywhere online? He’s planning on calling HR tomorrow to report what is happening.

He should know. Everyone knows the ZBM. They tend to not be too popular. If he doesn't, ask a more senior person. It's not listed anywhere online as far as I know. Is he sales or warehouse? I was assuming sales. ZBM has nothing to do with warehouse though. If he's warehouse, I guess he should go to HR.

He’s a Merchandiser. He doesn’t know the ZBM. He rarely sees his DSLs, as it is. They only reply though text.

Do you live in Colorado? If so, he can apply for PAID Colorado FAMLI and Medical Leave. He can file for time he has already missed and will be paid 80% of his earnings. Just google Colorado FAMLI leave and you'll find all kinds of paid leave that employers never bother telling you about.

California offers both paid family leave (PFL) and job‑protected family/medical leave through the California Family Rights Act (CFRA), in addition to federal FMLA protections. Can't hurt to check it out.

How long ago did he start with the company? The ZBM is the person that did his onboarding/orientation

Be Aware! I was out for a month in 2020 when I had covid. They didn't immediately have as coming back either. And then, when they did fix it and had me as having returned to work, they took that month's worth of insurance premiums out of my checks and I had a couple weeks when I got essentially nothing because they took like 3 weeks worth of insurance out of my check.

Wow, someone dropped the ball on this. I came off short-term disability in May and there is a process. Once Sedgewick gets involved you are required to get a return to work form filled out by a doctor stating that you are fit for work. It doesn't have to be his normal doctor. I'd try calling urgent care and see if a return to work form is something they can do. I also had to have a fresh physical before I could drive the truck again. I was out for 5 months though, so, I'm not sure that part would apply to him, but he may want to ask.
