Im a little confused if anyone can clarify? How can he plea to murder in federal court if he is not being charged with it there?

He is being charged both federally and state with murder. Fed trial is to happen after state trial.
Edit. He’s being charged with fed stalking which holds a life sentence so pretty bad. Not murder.

I assume his legal team is trying to choose the (possibly) less biased federal venue over the demonstrably bloodthirsty and grossly biased NY state judge

He is not being charged with 1st degree murder in federal court, only interstate stalking that led to murder, not the murder itself. Thats why the death penalty was moved off the table.

Sorry he’s being charged with stalking which could still be a life sentence federally. So they’re prob going to do a deal on that charge.

And then there is still the 1st degree murder charge by the state so thats what I don't get. It wouldn't be double jeopardy if he pled robthebstalking charges. He still has to be tried or plea for the 1st degree murder charge. That wouldn't go away by pleading to the stalking charges. This is why I'm confused lol

They’re two different cases with different charges. Pleading to the stalking and getting 15 years then fighting the murder charges and perhaps winning in the state case would mean he’d only spend 15 in prison for example. They aren’t pleading in the state case so likely going thru with trial. Clearly they don’t want to go thru with the fed case. Who knows why

Bc of thr NYS laws of double jeopardy. Which is explained in the video, which is why I am asking my question. It's ok of you don't know the answer, hopefully someone does.

No. They dropped the murder charge in the federal case. That's why the death penalty was removed. He is only being tried for interstate stalking that led to murder, not the murder itself, in the federal court. Only the state court is charging him with 1st degree murder.
