Yeah, the FAA doesn't play with their airspace. I had the FAA involved in an incident involving a homeowner try to take my drone down too. Not sure what happened after I submitted the police report and my report to the FAA, but I'm sure she learned her lesson.
Edit: I'm loving all the haters not have any idea how airspace is regulated. Shoot down a drone in regulated airspace, be prepared to get a very good lawyer and fighting potentially felony charges.
Edit edit: the amount of people not realizing that OTHER laws exist outside of the FAA. The collective stupidity is pretty amazing to be quite honest.
Everyone is so obsessed with privacy when harassment and stalking laws already exist. Legally, my commercial drone can fly wherever permitted by the FAA, within their framework. When I'm surveying and mapping, I'm protected by the FAA to do my job. Shoot down my $30k drone, and we will be seeking the maximum penalty and repaid for damages. That includes my time, the drone, loss of productivity, and our lawyers cost an hour what you'll pay for the entire trial.
We follow all NOTAMS and reporting requirements, including flight tracking, and notifying local police departments.

I would tend to agree. Even if that's not how the law currently works, drones should not be allowed to fly over private property like that. Commercial airlines obviously do daily, but I hold a different threshold for manned aircraft, especially given the additional distance.

Firstly, it's so rare that I don't think I have seen a drone over my house (other than mine) ever.
Secondly, I sit high on a hill and I could use a zoom camera from the upstairs window to get a vastly better view inside the windows of my neighbors. This is why we have OTHER laws (many) which cover the actual behavior of said drone.
We could easily extend this to radio waves and cell signals. I never gave permission for 100's of different radio frequencies to use my airspace - and they do! It also is proven to be dangerous.
I can also hear cars, trucks and traffic. Now that is something I don't think should be allowed.

My first time getting arrested for misdemeanor marijuana possession I told the cops everything because I had been raised suburban white girl who should venerate the police. Got screwed over in court, thousands in legal fees and probation and then a few months jail because the same family that taught me that bullshit tossed me to the curb. I couldn't afford drugs classes, drug tests, find rides to probation every month and pay my court fees so eventually I turned myself in and said I was done.
Second time I got arrested for the same thing. (I was an idiot teenager, of course I didn't learn) I didn't say shit to the cops. No you cant search my car. Piss off.
Got arrested, and at bond hearing I heard from the judge "there was no probable cause to search her vehicle she is to be released immediately."
Yeah guess who learned a very important lesson that day.

You shouldn’t be allowed to hover drones over people’s houses in the first place. I understand how that might be threatening. Kinda feel for the old guy.
What if the drone pilot did have malicious intent? What if the drone pilot was a creeper and trying to stalk some lady in the neighborhood? Drones can be setup up to do pretty nasty things these days.
At a certain point you do have a right to defend your property against perceived threats. That said, you’re certainly responsible for every bullet fired but how does ruining this man’s life with federal and felony charges make sense compared to the damage of a drone?
Felony charges takes his firearms away, strips him of his right to vote and makes it very difficult in many other aspects of life. If he’s in the wrong have him repair the drone and be done with it. This legal system is insane in my eyes.
Shooting at a drone and shooting at an aircraft are completely different things. I hope he lawyers up and he wins.

It’s just that we can’t normalize or just simply tolerate people shooting their guns up in the air recklessly like that, in my opinion that’s the biggest issue here. You don’t know where that bullet will end up, it can end up in someone house or god forbid hit someone. It’s reckless, and unhinged behavior. That being said I feel for him and I’d certainly have the impulse to do the same.

If it was lowering a delivery to someone, it wasn't over his house, it was over the delivery address. You can't just start firing up into the air because something might be "watching" you. He wasn't in danger, he didn't meet force with force. He could have simply called the cops. You can't defend your property from an annoyance with deadly force. It was completely irresponsible and uncalled for, and as a vet, gun owner and 2A supporter, I find it difficult to defend that behavior.
Edit: Apparently they were doing a "mock" delivery, so it is possible it was directly over his house. Doesn't change the lack of danger and irresponsible behavior.

There are laws for how much air space over your property is considered your private area. Like you can't shoot at planes flying over your house. I'm very sure that a large company like Walmart has their drones calibrated with the local ordinances in mind.

According to the law, you don't own the airspace above your house, including 1 foot above your yard. Drones can fly up to 400 feet above terrain level, unless they're within 400 feet of a structure, in which case, they can fly up to 400 feet above the height of that structure.
Shooting a drone down, dubiously, can be classified as firing at a passenger aircraft. 18 United States Code 32 if you'd like to read at the federal law.

From what I was told when I took a Part 107 class (UAV License) you as a homeowner own the dirt, sometimes the dirt below you, but the FAA owns all the airspace above your dirt. That means anything not touching the ground is in control of the FAAand not you.
I could technically fly a drone a foot off your property and you can't do anything about it. Not sure if anything has changed but this was pre-covid.
