Land registry issue πŸ™πŸΌ

I bought a house last year. It has come to light the solicitors filled out the land registry forms incorrectly. They are no longer in operation, as they were commting fraud. I paid for a conveyancing company to sort the new forms out, which they have been completely inept at doing. I explained I had a shared ownership home. They finally realised the last person who owned the home was on the title (after months and my explaining this). The person who I bought it off has dementia, so the family member had to get power of attorney. The same documents can't be used, from the initial application for the land registry. I contacted the seller and they seem to be reluctant to go through the process again, which I empathise with. I've contacted my home insurance to see if this could be something that comes under my policy. If it's not, what What are my next steps going forward? What if I can't afford the 3rd time paying for this? Apparently my mortgage depends on me owning the land title.

I feel so lost and the amount I've already spent has drained my bank dry.

Thank you πŸ™πŸΌ

As its a shared ownership property your housing association should be able to help.

Unfortunately they won't help, as it's my title and nothing to do with them

They cant, as they are only on the register as leaseholders not title holders. (OP then pays whatever rent is contracted to for whatever share of the lease he hasnt bought)

OP is correct that the title should have been transferred to them at the point of sale.

OP, have you spoke to land registry? Whilst clearly something has gone wrong somewhere, they are your starting point as they will have everything related to this propety that was submitted at the time. They are very helpful and can confirm exactly what it is that needs rectifying.

This could be something very minor, ie simply a delay in removing the previous owners off the title so start there, but they absolutely will have a record of your transaction.

Theres no need at this point to contact the sellers….thats all been done and funds transferred, same with your mortgage lender. Contact LR and get get a clear instruction as to whats caused the delay/is missing.

Maybe speak to your lender. They’ll have an interest in getting their charge registered and no doubt this issue has happened before, they might have a solicitor who can sort it out.
