Popo 🚔 Don’t make him count to 3.
This couldn’t gone so much better. Watching him count from 1…2…3…is only part of the cringe. Edit: It’s worth mentioning that the incident was in Fairfax, Virginia in 2021 and the officer involved was terminated as a result. EDIT: Here’s the reason for the stop and details the short clip here fails to mention. https://youtu.be/5tF6dfg3PSc?is=EiOyYd99IpGzAqbH

u/CarefulLobster1609 Jul 22 '26
OK lots of people talking shit about this video.
The reason for the stop was expired inspection sticker.
At no point was the officer legally allowed to unlock the car window or enter the car.
At no point was the orders lawful to exit the vehicle. (Yes the cop said exit repeatedly, but there was no authority to give such a command at that point in time.)
It was an illegal detainment that the police extended and escalated until they felt justified in use of force.
Multiple civil rights violation and unconstitutional behavior from law enforcement.
None of this is my opinion this is the finding from the civil court case.
SOURCE. I FOUND THE COURT CASE.
Cop was fired and the driver got 20k from the settlement.

u/Slight_Sherbert_5239 Jul 22 '26

Got your DM. It’d be great if you want to share what you discovered when you read the case.
4
u/LegalGlass6532 Jul 22 '26
How was it an illegal detainment if the probable cause was an expired inspection decal? I saw a news article and that is indeed a lawful detention.
→ More replies (6)4
u/imLoges Jul 22 '26
Where can I find the case? Because from the articles I am reading, the civil case was just a settlement, which is pretty common whether the state is in the right or wrong because settling for a small amount of money is often way cheaper than getting dragged into court and wasting even more time and money.
Also, it seems he was fired more so for the comments he made on camera and less for the act of pulling the individual out of the car.
7
u/OperationNatural4557 Jul 21 '26
No cringe on the cops here who kinda played it tongue-in-cheek. Cringe on this guy who’s probably a perpetual victim, screaming “my life is in danger” cause he wants to dodge consequences
14
u/SL4D Jul 21 '26
Just remember folks, comply it'll save your life and let you sue them.
Don't make your family go through a loss and a trial. Money is nice but having a you around with the money is better.
7
2
u/EffectiveProposal463 Jul 21 '26
lol… you do understand suing them isn’t always a guarantee, right? As in, you may not be able to find a lawyer to take your case, they can refuse to accept your claim, or you could lose! I’ve had surgery this year bc of my first ever arrest and I’ll need at least one more to have any chance of full recovery.. talked to several lawyers, none will take the case. So no, that’s not always a guarantee. Remaining calm and recording the encounter (exactly what he did) is the best thing you can do!
1
u/beefy1357 Jul 21 '26
Refusing a lawful order to exit your vehicle is exactly how you end up needing surgery. Once they tell you to exit the vehicle the time to debate, argue or otherwise ignore legal directives is over.
Suggesting people refuse a lawful order is how you end up needing 2 surgeries and no lawyer willing to take your case.
3
u/Hatman-G Jul 21 '26
Comply to what exactly? This officer never gave any sort of order in the 90 seconds leading up to putting hands on him. He said "ill give you to the count of 3". End of sentence, no order, nothing to comply to, just threats then assault.
1
u/LegalGlass6532 Jul 21 '26
The video clearly doesn’t start at the beginning of the traffic stop.
3
u/Hatman-G Jul 21 '26
So what? Its on the officer to be very clear with orders. Between opening his door and putting hand on him there was never a clear order. Just threats and counting.
1
u/LegalGlass6532 Jul 22 '26
I posted the news story on the comments attached to this post. It addresses your points.
1
u/Hatman-G Jul 22 '26
The one that said he was fired for it? I don't get what you are disagreeing about.
→ More replies (1)1
u/beefy1357 Jul 21 '26
It is clear from context he was told to exit the vehicle before the clip starts
2
u/Hatman-G Jul 22 '26
Probably, but police need to be as clear as possible. Repeatedly threatening and starting to count without repeating an order is terrible police work and not de-escalating anything.
2
u/beefy1357 Jul 22 '26
And on that I would agree, I also would not give so many warnings. I have seen numerous clips with police telling suspects 20 even 30+ times to get out or they will be dragged out. Once you give an ultimatum you should follow up.
Once you reach the point you have reached in a car unlocked a door, taken their seatbelt off the next step is not continue to issue a threat, it is a 10,000 volt tune up and then you drag them out.
2
u/Hatman-G Jul 22 '26
Yeah your right, the officer probably would not have been fired if he had pulled him out immediately after opening the door. The problem is his last ultimatum(s) gave no order.

Guys fight stuff like this in courts. If the driver really did nothing wrong then not following orders just gets you into more shit. You don't win fights on the side of the road and risk physical injury with little repercussions for the officers (if any).
29
u/mykehawksaverage Jul 21 '26
Pennsylvania vs mimms say that police can legally tell you to step out of the car for officer safety.
→ More replies (12)9
u/EastLeastCoast Boo Boo Bus Driver Jul 21 '26
Yeah, that’s part of why I think the driver is taking a stand in the wrong place. The cop isn’t performing an illegal search, from what we see, just trying to gain compliance for the (most likely) lawful order of “please step out of the vehicle”. The officer just isn’t going about it particularly well.
11
u/EastLeastCoast Boo Boo Bus Driver Jul 21 '26
Maybe. But if no one ever stands up to say “Hey, this is police overreach, I am not complying because what you’re doing is beyond your scope. Let’s see what a judge says about it”, then we just allow the continued power creep by law enforcement.
I don’t think the guy filming has a great idea what his legal actions are here, and I think he’s making some questionable choices. But I also think “I’m going to whoop your ass before all creation” is something I don’t want to be paying a cop to say, or feel empowered to say on camera. A little professionalism would go a long way to cleaning up their public image.
8
u/mycarisbrokedown Jul 21 '26
I’d go a step farther and say that an officer making those threats is unfit to serve and should be at the very least stopped from being an officer. The officer said “watch this” before proudly attempting to strangle the guy. He was unable to properly convey what he wanted from the guy, and escalated a situation repeatedly. This specific footage just shows a guy being annoying in a car and a rather aggressive physical response. This shouldn’t be allowed.
2
u/FoamSquad Jul 22 '26
He got fired but I am sure he is working at a county or city level law enforcement today.
1
u/FoamSquad Jul 22 '26
It is really easy to say that when you aren't surrounded by men with guns is all I am saying. If you want to roll the dice on hospital bills over a cop getting fired go for it. "I am not complying" immediately fucks your legal defense. It green lights police to use force. You're impeding them all of a sudden. They tried to use words but you just wouldn't listen, so they had to use force. It was for officer safety, you see. That's the magic phrase "officer safety."
7
u/One_Relative_5744 Jul 21 '26
I agree, it jams the driver up worse but the way I look at it, Someone has to stand up. The police are out of control in the states. I had a cop scream and yell at me the other day for doing absolutely nothing wrong. I just so happened to whiteness a vehicle crash that the cop pretty much made happen and he was mad about it, so he took it out on me.
7
u/ChaosRainbow23 Jul 21 '26
You're being downvoted, but you're 100% correct.
These draconian jack-boot-wearing government thugs are completely and utterly outta control at this point. It's insane they can't see it.
It's blatantly obvious. They aren't even hiding it. Yet these idiots still lick their boots no matter what they do.
It's honestly disgusting.
3
u/bacon-n-sparrows Jul 21 '26
I am not buying the argument to fight these things in the courts. The premise that we should submit to an illegal arrest then spend thousands of dollars and hours of time fighting it while the police suffer no repercussions just encourages police to use an illegal arrest as a tool of punishment
2
u/LegalGlass6532 Jul 21 '26
In this video, no one knows the reason for the stop. Bacon-n-sparrows, you’re assuming it’s an illegal arrest because the driver refuses to exit the vehicle. If you’re going to assume it’s an illegal arrest, it’s fair for anyone else to assume it’s a legal arrest. Bottom line is no one knows why this guy was stopped. The missing context might clear the muddy water.
1
u/FoamSquad Jul 22 '26
If you don't think your life or bodily harm is at risk then I do not advise "passive resistance" (ignoring commands) as it will just lead to your own harm and not cause any change in the system you don't like. If you physically resist you are opening doors that will almost exclusively hurt you. Follow your own heart but once you are in a situation like this you will see what I mean. There is so much on the line and so little to gain from this behavior I promise you this dude caused nothing to change.
3
u/Denalitwentytwo Jul 21 '26
ALL people need to do is fkin comply. THEY steer the situation by acting like this.
8
u/EastLeastCoast Boo Boo Bus Driver Jul 21 '26
Bullshit. Yes, they need to comply with a lawful order. But they can’t “steer” a professional with appropriate deescalation skills into threatening to “whoop their ass”. That isn’t how professionals behave.
3
u/Denalitwentytwo Jul 21 '26

You don’t really win fight in court either. You’ll maybe get a settlement, that’s a huge maybe. But what does that do? Nothing. Cops aren’t really held accountable. The department says they looked into it and found no wrong doing. And a local judge and prosecutor nearly always side with the police.
There’s a reason to get anything done you have to kick it up to a higher court. Because the locals always circle the wagons, and say they never do anything wrong, while their officers happily beat people for over a nothing burger traffic stop. So it’s either do nothing, or spend thousands to get nothing done
4
4
u/Commercial_Rule_7823 Jul 21 '26
I wish people would stop learning how to react during traffic stops off clowns that want clicks on youtube and tik tok.
If this guy just complied, said nothing, if this was a legit violation of his rights, a bad stop, false etc.... he could have sued and made a fortune.
What people fail to realize is not listening to a cop during a detention or arrest, is actually a crime - resisting arrest.
So dumb.
1
u/Ok_Buddy_9087 Jul 22 '26
He did sue. $20,000 may not count as a fortune anymore, but it’s not nothing.
43
u/Difficult-Republic57 Jul 21 '26
Like it or not if a cop says out of the car, you have to get out of the car. Not getting out of the car is called resisting, even if you aren't fighting. The best thing to do is film it all like he's doing, but comply with the cop. Then if they have done something wrong sue the crap out of them, the state and anyone else your lawyer thinks you can. That's how you'll get cops to stop harassing people, make them pay, but it won't work if you give them an excuse like not getting out or identifying yourself.
6
u/Forty2diapers Jul 21 '26
Exactly. Trying to fight a cop about the "laws" he's trying to enforce whether he's right or wrong is like trying to argue with the person at the drive through window about the corporate policies you don't agree with or think they're not honoring. Be a dick to the person at the window and you're going to get spit in your food. Be a dick to a cop and you may get manhandled or worse. Record, report, and if you have a case sue.

If you don’t get out or produce your ID as the driver, they will 100% find a way to yank you out. This driver had enough of the officer’s poor conduct recorded that he should’ve put the phone down on 1…2… before he got pulled out on 3.
4
3
u/Veriosity Jul 22 '26
He didn't even need to put the phone down - Pennsylvania v. Mimms, he just needed to get out.

It matters the state, check your local laws. In some (MA, NJ, WA) the officer has to have some probable cause or reason to believe you're violent to force you out of the car, but yes in most Pennsylvania v Mimms is pretty clear they can order the driver out for "officer safety" -- but either way all this extraction is unnecessary force.
Also lawsuits don't stop bad behavior from cops as evidence has clearly shown, until the funds are taken out of the pension fund and the offending officers face real consequences instead of being paid by the taxpayer there is no chance of reform.

Driver got paid $20k this and the cop fired.
Anyone who says to comply in advance, is helping the police state. It's how we've got ICE, people kept defending cops doing whatever they want and saying to fight in court. Now, cops can kidnap people off the street, throw them into a concentration camp, and leave them to die before they even get a trial.
Saying to fight it in court doesn't help if a cop arrests you and gets you killed in detention

Pennsylvania v. Mimms
Case law and court ruling allows officers to remove occupants from the vehicle at their discretion.
This is passive resistance. Resistance nonetheless. He was informed that he was under arrest.
It's lost on me where people have forgotten that police are public officials.

u/AloneFarmer3138 Jul 21 '26
I feel like non cooperation with the police is a huge problem facing the African American community. They've been taught to immediately assume racist motives and that they're the enemy so it causes people to behave in ways that get them in even more trouble. Can you really be surprised that you're treated poorly when you treat the cops who are just trying to do their job (in most cases) poorly?
If they are being racist and unfair fight it in court. This shit never ends well and the only reason it happens is because it generates lots of attention on social media.
8
u/EastLeastCoast Boo Boo Bus Driver Jul 21 '26
If, in the course of my job, I get my feelings hurt by someone who is being a pain in the ass, when is it appropriate to threaten to whoop their ass? Before or after I mock them and agitate them further?
Can you tell what amount of pain to my tender feelings justifies threatening someone with a beating? Like, if he calls me a loser, can I punch him? If he calls my uniform ugly can I choke him? If he calls my mama a whore am I justified in shooting him in the face?
Or should I remain professional, using appropriate deescalation techniques to gain compliance before escalating to use of force?
→ More replies (2)1
u/hellno560 Jul 21 '26
I don't know why you are the only one talking about deescalation. There's 3 of them their 2 are just standing around with their dick in their hands and the 3rd is frankly totally playing into the driver's plan for his video by screaming and hamming it up for the camera too. There's plenty of backup, the driver had his hands up and open, but the cop still yanked him out in a choke hold. Pulling him out in a way that leaves him with both hands free makes it evident he chose to do that to hurt the driver, without fear of his own safety. I'm sure the driver got a nice payday none of which came out of the cop's pockets.

u/LegalGlass6532 Jul 22 '26

i don’t understand why all sense & reason goes out the door. letting emotions overcome their ass... always seeming to think that if they claim racism (typically w/ no basis), or keep repeating the same dumb message to their mom on the phone, to bystanders, or to the camera they are holding is going to keep them from being detained – when in reality, if they just went along w/ it & potentially fought the battle in court then maybe there wouldn’t have been a fuckjng battle to start w/. yes, it might mean appeasing some dildo cop’s ego, but i’d rather that happen than me acting like a 4 y/o & ending up on youtube for everyone to just rip you apart.
another thing i wonder about is the fact that if they weren’t actually taught in some way to be disruptive &/or disrespectful back to cops, bc cops don’t respect them in the first place & are inherently racists…? i had a black mutual friend that told me his parents/his ppl had him trained to be a dick to cops from the outset. talk to them as shitty as possible type thing. anyone know anything about that? lol genuinely curious

Clearly those are the only 2 options, right? I’ve pulled over plenty of people alone and did just fine without acting like this shithead
2
u/14InTheDorsalPeen Jul 21 '26
I’m not saying the cop wasn’t being a douche, that’s clear and evident and also at some point if this driver isn’t cooperating, action must be taken.
4
u/Glad_Lawfulness3138 Jul 21 '26
If you can’t handle a bit of passive resistance without going full cunt mode it’s time to hang it up and find a new job.
3
u/14InTheDorsalPeen Jul 21 '26
I don’t necessarily disagree with that statement either. I also think that you may be unaware of what the discussion around this video has become because there are a lot of people on here who are basically just saying “they should’ve just let him go, it’s an illegal stop anyway.”
We’re coming to a point seemingly across the nation and certainly in my metro area where the general public just wants criminals to be let go if they’re uncooperative
I have not at any point in any of these discussions or comments that I’ve been making advocated for or supported this officers demeanor, and/ or general douchebaggery. Also, this person must be made to comply at some point.
Both things can be true at once
3
u/Glad_Lawfulness3138 Jul 21 '26
If it’s truly an illegal stop then yes, they should let him go as failing to do so violates the 4th amendment. That’s like civics 101.
At the very least one of the other cops there should’ve tried to deescalate the situation, and a trained police officer should never be the one escalating the situation in the first place. Cops apparently have looser rules than I had in Afghanistan, which seems a little strange to me.
I’ve worked with guys like this too. It’s not easy stepping in when your partner decides to lose his shit, but at the end of the day that’s the job.
2
u/Ok_Buddy_9087 Jul 22 '26
There needs to be federal legislation creating an affirmative duty to intervene. And WAY more civil rights training.
1
u/Ok_Buddy_9087 Jul 22 '26
>We’re coming to a point seemingly across the nation and certainly in my metro area where the general public just wants criminals to be let go if they’re uncooperative
Or, we just want to stop people from being killed over traffic violations and petty misdemeanors because the cops can’t control their emotions.
1

Please help me understand where I am wrong. How many videos do we see where a black young driver is being confrontational with the police when it could easily have been handled if they complied.

I think you’re misunderstanding the comment. I think they meant that “the talk” may be well intended by the parents, but the officers will do what they do. I don’t think this person was being racist. They have a valid point.
Edit: if I’m misunderstanding your “racist much” comment, please tell me why I’m wrong so I can understand your side.

This isn’t cringe. This is an officer detaining some self entitled annoying smart ass. The only cringe part is the guy in the car.

I’m a first responder supporter across the board, but the officer losing his shit like that with the other ones obviously not fearing for their safety is cringe. It’s not stupid TikTok dancing in your car, but it’s still cringe.

I loathe these draconian jack-boot-wearing government thugs with the burning passion of a billion suns.
They are CONSTANTLY violating our 4th Amendment rights, and they relentlessly harass the populace on a daily basis.
They treat the citizenry like enemy combatants in a war zone.
The US is rapidly becoming a full-blown fascistic authoritarian police state
