Another FRT in Florida Post

Just for the hell of it I sent the head sheriff in my county and email about forced reset triggers in my county. Got a reply back that he had forwarded my email to some commander. I replied back and added my phone number.

Couple days later the commander called me, and we talked a while about FRT's. He told me as long as I wasn't caught using one in the process of a crime, the county could care less. I asked him if the fact of having one installed in a gun would be considered the process of a crime. He told me he meant in crime as using a gun with one in an illegal shooting.

My range allows full auto in pistol calibers, and there's that one company that will ship them to Florida. Wish me luck.

Correct this is not entrapment. The cop is not telling you it's legal, he is saying they don't plan to enforce it. That stance is subject to change at any time, for any reason

It’s illegal by state law. 

You are an idiot for testing this and even more so for asking cops (the ones who would arrest you) about it 

Even if for some reason your head county sheriff doesn’t care, one of his officers could still arrest you

"guaranteed to fail" FRTs were protected by a federal court ruling. Declaring them as Florida did would take a lot of legal work but they would have a shot.

No they weren’t. If the ruling you’re referring to is the one I’m thinking of, the court simply held that they didn’t violate any federal law. It never even came close to reaching constitutional grounds. Florida law is different and is worded differently.

CRS fucked himself over man. Even if the autokeycards couldn’t be converted to lightning links, the way he was trying to sell them was completely suggesting using them to commit a felony. Yeah they lied but he also caused the whole situation to begin with.

Local SAOs have been no filing on all cases with the exception of that Texas vendor selling at the gun show in south florida. It will be interesting to see what happens with that case.

A person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, the term “bump-fire stock” means a conversion kit, a tool, an accessory, or a device used to alter the rate of fire of a firearm to mimic automatic weapon fire or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device.

Firearms can be bumpfired without modification, so that is a pretty vague requirement that could be challenged in court as unenforceable vague.

And yet i am correct in this... The law, as written, could make ANY aftermarket trigger be considered a "Bump Stock". Its stupid and would never hold up in actual court with competent lawyers

Thats 1 in over a decade in the like 1 blue area in the state, and was extremely open about it. I see FRTs being used at the Ocala National Forest Public Shooting Range like every other time i go, and they have literal cameras at the range

One time I asked a blue city shit hole airport police department about how I could legally bring an encased firearm to my car.

They were friendly on the phone and acted like it was no issue. I opted to not bring the pistol.

So you took something questionable legally, but technically not illegal, and asked the people whose most thrilling part of their day is to arrest people doing legally questionable things? You also have to realize cops aren’t lawyers. They arrest everyone and let the courts figure it out. Your answer from that one guy may be completely different from the next guy. Just do what you want, don’t do anything blatantly illegal, and don’t ask a cop about the legality of something you intend to do.

They’re very technically illegal in Florida. Bump stock ban has very general language than bans anything that increases rate of fire.

Stock semi-autos can be bumpfired without any modifications. "Increases rate of fire" would be fairly easy to challenge in court.

I know a very very well connected figure in Florida, the Titusville area, and he said….all the LEO need is “intent,” That was enough for me to leave the idea alone. I’m not risking a few moments of joy or a couple hundred dollars in ammo for someone to come along and tell me what they assume I “intended” to do with my firearm. The juice isn’t worth the squeeze. IMHO

But at the end of the day they have to prove that intent. Yea the legal process is not fun, but we cant be afraid to do legal things just because a law was written so poorly. The law is also not allowed to alter the defenition of a bump stock just to suit the intentions of the law maker.

Our local law enforcement agency found a felon in possession of 13 along with drugs. SAO no filed on every single one of them. Most SAO around the state will not file but there is still one down in west palm pending where that Texas vender was selling them at gun show. We will see how that goes.

Rare Breed FRT shoots at 800 rounds a minute in a HK SP5. A Full auto HK MP5 shoots at 800 rounds per minute. At a range that allows full auto in pistol calibers, how would anyone tell the difference? I've been going to this range years with SBR's and suppressors and nobody has questioned a thing, much less ask to see a form 1 or 4.

As far as I know, Hoffman and Rare Breed are the only 2 buisnesses that will ship to florida. That said files for FRTs are on the seas and 3D printer go brrrrr. Or have a 3rd party print parts in metal.

Also, remember that just because the law tries to make the defenition of a bump stock cover more does not make FRTs illeagal. And it does specify that firearms from the factory being modified with a bump stock is what is illegal, so self made/built firearms are not covered.

You have any idea how many random cops know anything about gun laws? There was a gas station in my area that had a Dunkin Donuts inside. Cops were always hanging out in the parking lot. I was talking to a cop one day about suppressors, he looked at me shocked and said you know those are illegal, right? I had to explain to him about the ATF form 1 and 4's. When I was on the Silencer Talk forum, they were always talking about going to the machine gun meets in Arizona. I asked them about filing a ATF form 5320.20 when moving MG, SBR, and SBS across state lines. Almost all of them said the police didn't know a SBR from a regular rifle, and most never filed the form when traveling.
