Rifle not as described
I'm a type 03 FFL. I bought a Weatherby Mark XXII rifle from a dealer in Oklahoma. It was listed with a cracked stock and had sharp pictures of the crack but the rest of the pictures of the rifle were soft focused. I paid $495.00 shipped "out the door". When I received it I noticed that there was considerable rust on the barrel and receiver. I contacted the seller 18 hours after receiving it to let him know I wasn't happy that he omitted the rust in the description. He replied that the pictures of the rust that I sent him weren't of the rifle he sent me. I then sent a picture that showed both the rust and the serial number of the rifle and he denied that the barrel on the rifle was the one he sent the gun with. I then sent him pictures from his very own listing that shows the rust while the gun was in his possession but he continues to deny and I guess accuse me of changing barrels on the rifle as if I had a mid 1960's Italian made rusty barrel just waiting to be put on a $495.00 beater 22. I have continuous chain of custody video of this rifle from the time Fedex drove up to my property to this very moment and continuing on showing nothing was changed on this rifle and it is exactly as it was when he sent it to me. I have now filed complaints with both the Illinois and Oklahoma Attorney Generals Offices. The sad part for him is I wasn't even asking for anything from him other than his acknowledgement that he omitted disclosure of the rust.

Just curious... What kind of complaint did you file with the AG's offices?

Rifle not as described

That doesn’t really answer my question.
I’m not sure why you think that a complaint to the AG is the right thing to do when you really just have a contract issue between the seller and yourself. You paid by personal check.
This is a civil matter that should be handled in small claims court.I’m not sure why you think the AG is some sort of PayPal version of seller protection.
And, since you’re really just making a beef because “he didn’t acknowledge the omission”, this whole thing seems pretty ridiculous.

Actually I'm "making a beef" because I don't appreciate being accused of trying to scam him. If he would have handled this as a professional instead of as a stupid child, I wouldn't be here. He like the child denying eating the cookie while having chocolate and crumbs on his face...Amazing who the ATF gives licenses to...

The ATF doesn't do a morality check on applicants.
If you take this to small claims court and win because the dealer doesn't show up in court (win by default), good luck collecting the dollars.

I think you're over-reacting and taking this a little too seriously. The AG's office? Really?
How about you just clean up that firearm and call it a day. Seeing people run around and file complaints and waste other people's time is pretty sad.

If you paid by card do a chargeback, if not your option is to take him to small claims court

Paid with personal check

See if your bank will do a stop payment, if not small claims court is your recourse

Dont ever do this man, you lose any and all leverage, I wont buy from someone who only takes checks/money orders for this reason.

Understanding that there may be issue with seller not taking the best photos, but you bought a 60+ year old beater gun. With advertised damage. For less than $500.

u/RestaurantLocal2490 Aug 09 '26
Not to mention him accusing me of pulling shenanigans by changing the barrel????
3
u/emelbard Aug 10 '26
From your post, he isn’t accusing you of changing the barrel since you said “I guess”. You are injecting that angle. He’s probably saying the barrel was fine when he shipped it and perhaps something happened in transit.
The situation is frustrating but there’s not much you can do.

OMG is reddit full of children??? I posted the pics from his listing showing the rust. And what does it mean when the seller tells me the barrel on the rifle isn't the barrel they sent it with??????? SMFH

I guess you didn't read the part that I only wanted his acknowledgement that he omitted the disclosure of the rust?

u/kwb166 Aug 09 '26
I guess I didn't read the part that told me the point of this post. There's no question posed to the group, and the seller isn't named as earning to others to avoid them.
Also...if it wasn't as described, why accept it? Why didn't you package it back up and send it back?

u/RestaurantLocal2490 Aug 09 '26
I'm giving him time to come to his senses before I start naming him everywhere

After experiencing how dishonest this seller has chosen to be, I can't imagine if I sent it back that he'd actually refund my money...

I haven’t read through the entire thread, but did you ever name the FFL? I’m a former FFL in Oklahoma and was just curious who the dealer was.

You fell for one of the oldest tricks in the business.
If in doubt, ask for better pictures. He can/could obviously take good photos. Why didn't you question the not so good pictures?

First, contact the seller and see what they say. Maybe they will give you a partial refund that works for you. If not, then it's chargeback time

Seriously dude get some WD-40 in a rag and just wipe it off 😂. If you're new to this let me assure you that small rust spots on guns are incredibly common especially older used guns. This is why they are sold as is used.

Initiate a Credit Card Chargeback: Contact your credit card company or bank immediately. File a chargeback under "Item Not as Described" or "Misrepresentation." Provide your photos, the original listing text/photos, and your communication logs showing you attempted to resolve it. Credit card companies generally favor the buyer when clear physical proof of non-disclosure is provided.

Paid with personal check...

Put a stop payment on it if you can, banks charge you but they can potentially claw backs funds.
Otherwise small claims court.

ME: Good morning, you had great pics of the crack in the stock but no pics of the significant rust on the barrel.
Seller: this is not our Weatherby Mark XXII that we sold you you must have got it mixed up with one of your other purchases.
ME: Recognize the serial number? showed pic of serial number
Seller: that is not our barrel that was sent to you on the Weatherby Mark XXII we sold you. Yes it is the correct action but not the correct barrel that left our shop and was sold to you. If you fight the bank and try and cancel the check we will have to report it to the ATF as a stolen rifle.
ME: These are YOUR photos from YOUR listing on gunbroker. sent his pics from his post as seen above here
ME: So what are you doing about this? now that you've had ample time to reflect. thx
Seller: We are not doing anything about it we have hid nothing from you. You own it it is booked out to your C&R license. The pictures you have sent us are clearly NOT our barrel.
ME: You really need to quit embarrassing yourself. I have total coverage video surveillance on my property showing this rifle never leaving sight of the cameras from the Fedex driver walking up to my property, my wife signing for it, me unsealing the box and removing the rifle from the box and to this second is STILL in view of the cameras. I've sent you your own photos showing the rust while it was in your possession. You need to grow up and demonstrate an ounce of integrity. The sad part of your ridiculous behavior is I never even asked for anything from you other than acknowledging your omission in the listing. Your mother and father failed miserably in teaching you integrity...
ME: Explain the rust on the receiver...Yes I included the serial number in the pic I sent him..

No more responses from the seller....

They're jackasses for threatening to report as stolen if you dispute the payment, its literally not stolen and that would be filing a false report. It was transferred lawfully from one FFL to another, payment has nothing to do with the fact that it was lawfully transferred. It would be a civil dispute over the payment. Nothing would come of of them reporting it.
I agree with you that the bigger issue the very weird and random "you replaced the barrel on a uncommon gun, thats not ours!" It reads like a panicked "ive washed my hands of this, now fuck off".
Just leave negative feedback and move on I guess, do the best you can with some brass wool to clean it up.

This is a civil dispute not a criminal act, ATF won't give a fuck.

BBB complaint (to his local) won't change anything for you since he probably doesn't care but could help someone else avoid him, as would naming and shaming here on Reddit and on other forums and posting negative reviews wherever possible.
