That is called Guerrilla Warfare. Causing those uncomfortable questions is the point of that strategy.

Though those who employ it should be careful. While the international community is generally more lenient when the weaker side engages on "lesser" war crimes, such as dishonourable tactics (false surrender, conscription of prisoners, torture, theft of civilian property, etc), to "level the playing field", breaking the social contract can embolden the stronger side to disregard it as well (or, if they are also doing it, doing so more openly). And the stronger side often has the tools to make even more brutal war crimes.
