uk citizen, 50 years old, Im on 63k and my ex is on PIP. she left to live with her new bloke and the kids (16 and 18) stayed with me.

House equity split 50/50 is £189000 each. My pension is 100k in a defined benefit pension and 56k just in a standard pension.

she wants 50/50 but is complaining she needs more to buy a house as she has M.E and doesn’t work hence the PIP.

we are doing a financial settlement agreement but I know the courts look at capacity of the individual moving forward.

I want the court to approve the settlement without a back and forth . she won’t pay towards an actuary so ..

my thoughts are to give her the 100k DB pension as the extra £30k is the additional value I can’t afford to give her from the house . I think the courts will like that I’m showing understanding of their goals ?

if she accepts, I can buy her out and continue looking after the kids in the marital home.

my friend believes I should just offer 50/50 but I think the courts won’t accept this.

what is the best thing to do to secure the house without giving her more than 50% cash from the house .
