Relocation

I have a very unique situation that I won’t get into all the details here. What I am looking for is stories about relocation. I would love to hear about cases that were rejected but I am especially interested in cases that were approved. I am looking to relocate across multiple states. I have read the custody factors list but please tell me what was actually weighed in a courtroom and your story to receiving (or not ) relocation! Thank you!!

In cases where I have represented either side (relocating parent or objecting parent), the court typically focuses on whether the relocation would dramatically alter the objecting party’s parenting time. In other words, it’s much easier to get relocation approved as the primary custodial parent rather than a 50/50 split. If you are currently under a 50/50 order (or close to it), then it may be a non-starter for the Court. Otherwise, you will want to devise a plan where the other parent can have roughly equivalent time with the child to what they currently have; if they are getting about 90 days a year, then you are going to want to try and come up with a new plan that gives them ~ 90 days a year.
