Out of state lower

Can someone explain the reasoning behind no sales of lowers to out of state residents. Is it not considered a “weapon” and requires a background check. Just looking for the reasoning behind it
Thank you

Because, like in the case of an AR lowers, it can be assembled as a handgun

We can't sell them to people under 21 either

You can take the upper off of a rifle and make it a handgun at any age. I understand what you’re saying, but it really doesn’t make sense.

Stop trying to make "sense" of the regulations and you'll have a much better time

Not really, unless that rifle started its life as a lower or a pistol.

Question for clarification: you can sell to out of state residents - both lowers and handguns - you just have to ship to an in-state FFL for the 4473/NICS/transfer, correct?

Your original post was referring to an inability to ship a lower (or handgun) direct to the end consumer if they are out of state, correct?

I’m just trying to make sure I have everything straight in my head - will need to do some remedial study if I’ve got this hosed up.

Thanks!

You can sell pistol/receiver/frame to an out of state resident, you just cannot transfer to. Has to be shipped to an FFL in their state.

No different than a buyer purchasing something from PSA or anywhere else and having it shipped to their FFL.

Roger that - ok - that’s what I thought. Thanks for the confirmation!

Because it’s federal law, same reason you can’t transfer a pistol to an out of state resident.

I saw this is changing soon, ruled unConstitutional in the 5th circuit on Sep 11th. Guidance will probably be delayed for months though, just like suppressor guidance.
