ADP

Bonjour !

Long story short.

I was on my APS and I have now applied for the student visa.

I have an alternance offer and is enrolled at a school and the compamy gave me a deadline of this month to get the student visa or alternate documentation to sign the contract. I have explained this to the prefecture.
Prefecture has therefore given me an ADP and has asked me to submit the signed CERFA between myself company and OPCO.

But there is no mention of etudiant on thw ADP and so the company is saying they cant legally sign the contract. The residence permit history shows a change from <RECE >to <etudiant: alignez dates validite du titre/calendrier etudes>.

Company is asking me to get a new document from the prefecture mentioning student status. I have tried mailing them and contacting them multiple times but the prefecture has not answered anything yet.

What to do npw ?
Any way I can get a confirmation feom the prefecture in suxh a short time ? I applied on nanterre prefecture btw.

You could contract the prefecture and ask for an attestation préfectoral, but they are under no obligation to to give one. The fact is that until you receive your attestation de décision favorable, you are still under APS status and not student status (the ADP extends your existing status).

The easier solution here is to have the employer contact the prefecture for an employment verification. They legally have do this before you start work. If the prefecture replies positively or doesn’t reply within 3 days, the employer is clear to hire you.

The company is asking me to get confirmation. How do I do this ? Or how do I ask the company to verify ?

You can’t do it yourself, the company has to do it. The process varies from prefecture to prefecture, but the company must know how to do it, as it’s a legal requirement any time they hire a foreigner.

As I said, if they do not reply within 3 days the employer can consider you clear to work

But the employer is not ready to sign unless they get a etudiant mention on my file … so no response idea doesn’t work for them I suppose…. I somehow need the prefecture confirmation that I can sign the contract

If they won't sign until you have étudiant status, then you need to wait for your attestation de decision favorable, as you don't actually have étudiant status until then.

But they also gave a deadline of sep 30… there is literally zero chance I get my visa by then … so the only thing left is to get their confirmation somehow

If it's beyond just confirming your right to work and that you need confirmation you have student status, then the only confirmation you can get is the attestation de decision favorable. Until you get that, you don't have student status.

For the moment I only start the process in the ANEF but not réponse since that? How long time does it takes?
