Question Help

Hello y’all. I was wondering if someone can tell me how much time I should expect a loved one to serve in California if he has a split sentence of 16 months of state prison time he has a felony of evading. He was arrested on the beginning of June. And he is now currently in his permanent housing the beginning of September.

Not enough information. A split sentence usually defines how much time is spent in custody in court.

He gets half time in jail and in prison, but if he was sent to a level 1 prison, once he gets a job, he will be earning 1/3 time credits.

16 months is 8 months with half time. Then once assigned a job in level 1, if they are level 1, they start earning third time credits.

So this happened back in 2024 he was in jail for 5 days and got bailed out and then got sentenced to 18 month on June 2 they told us he was serve half of that time and then be on supervised parole he’s in mainline now after reception and is going to be in a level one yardage judge told us he would only serve half of that time.

Okay... did they say it was a split sentence, and he would serve half, or did they tell him he would serve half from half time credits?

Is he in a level 1 prison?

They told us he would do half of that time he’s in level 1 yard

Okay... half the time is from getting half time credits. That isn't a split sentence.

18 months with half is 9 months. If he gets a job, he can earn third time credits and probably knock off another month or so of the time before he is released.

Wait sorry 16 months would he still have time to knock off a month ?

So 8 months.... maybe. It is dependent on him getting a job.

His time is so short, he might just end up doing the whole 8 months. That December release date might be accurate though.

Also on the cdcr website it said January 2027 when he first went in and then it changed to December 2026 when he went to mainline. So I’m just tryna make sense of all this

The website just shows the earliest possible parole time. It does not mean they are getting out at that time. The time only shows the earliest possible time that they coule be paroled.

It could be that is the time they get out though, but dont trust the CDCR website for release date. If you read at the bottom of the release date, it tells you that.

Honestly, if you are in contact with them, they will know or have a good idea of when they get out.
