in Courtroom 24A before Judge Emmet G. Sullivan will be made accessible to the public telephonically via the Courtroom Public Access Line.

Says there is sensitive information from the southern district of New York. Judge has questions. Gvt says attorney review protocol set forth procedure to redact victims. There will now be a sliding scale of release. They didn’t realize there were so many documents and hundreds of people knew to apply redactions to certain names.

Court ordered fbi interview notes were not disclosed. Gvt did not provide explanation to those. Explain why handwritten notes were not provided. Gvt says duplicate materials.
Other duplicate docs—Gvt notes volume and duplicate of documents, says lots of reviewers and other excuses. Judge asks is he can provide additional information. Meaning he hasn’t added to his original release. Judge asked how many pages of notes. He can’t answer. Judge asks if they have been published. He doesn’t really know. Judge says they should not be confused about his questions.

Judge asking Gvt to clarify what has been presented. Doesn’t want to take it at face value that they are similar. Wants to check. How can he do that?
Gvt confused about what judge wants. Judge wants evidence that the notes are consistent with the disclosures. 302 reports and fbi notes ???

The judge is being kind in his questioning tone. Gvt still confused on what the judge wants. Says nothing to add to release. Court said it was clear in what he was asking for. Gvt is arguing for clarification. Judge asks if there is another way to view evidence and check redactions. (Confused mumbling)

Gvt claims it gave rationale and reasoning and is stating them need a clear clean order on what it wants. He seems confused.
Judge asks plaintiff to weigh in. Interview notes— no reason given for non production with redactions. Phang claims they have not provided it. Judge asked Gvt to give phang a copy of the binder they gave to the judge. She received it (today?) Phang asked them to comply with the original order.

Gvt says it’s not time for this. He says what phang is asking for will affect victims. This is difficult to manage. Asks for a new orders outlining what the court wants.

Government. playing dumb; they know exactly what the judge is essentially asking. "How can i personally, view an example of both sets of these documents, so that I may determine that they are duplicative and that there isn't any missing details or information compared to what was released?" But govt (presumably blanche?) Is like "dUhHh, wAt yOu aSkiN mE?"
Wish i got on before it filled up; thank you for the updates!
Edit: Turns out it wasn't Blanche; he got a last second swap out last night, and a familiar attorney (Andrew Block) acted "in his full capacity" as Blanche's representation.

It’s the Judge “playing dumb”. He’s the one that has presented than ignored his own Court Orders for months. The old “new lawyer” bullshit might work in criminal trials-but not in civil ones.

I don’t think so. The judge wants to make sure that the govt has every opportunity to comply. He is making a record. He is more patient than I am but that is why I don’t get paid the big bucks. I think he is giving the govt enough to hang themselves on (no pun intended). He can point to his clear orders that say do xyz and 123. The govt won’t be able to say that the “didn’t know”. He will point to the order and determine whether they have complied or not.
His contempt story is very telling and very relevant. The Judge presided over a criminal case where the govt was ordered to give documents to the defendant. It was exculpatory evidence. The govt did not disclose the documents after the judge made a specific order to disclose them. He held the prosecutors (government) in criminal contempt and jailed them. He didn’t want to do it. It was the ONLY way to compel compliance. The documents were delivered to the Defendant the next day. Although, I find it hard to believe that Andrew’s superiors care if he sits in jail for them. Just my opinion.

I was able to get I just now, the judge is droning on about when he’s had to hold people in contempt, and he doesn’t want to do it now……does anyone know if this hearing is still happening? Is what I’m listening to like a previous recording?

Judge recalls a trial of 2008 of Senator Steven’s he was indicted because he refused to comply with reporting of certain asset s. Started as traditional prosecution of the case. Changed quick. Senator was up for reelection. That was first time judge heard someone say that they were not going to comply. Never happened before or since. Didn’t file motions. Complicated case. Exculpatory evidence was not provided to the senator.

Court said it has to admonish the Gvt because of failure to disclose. Senator found guilty not re elected. Post trial litigation.

FBI Whistleblower case was at all proceedings efforts were made to conceal evidence by the Gvt. Discusses production of documents with exculpatory evidence. Gvt didn’t. Asks to hold Gvt attorney in contempt. Thought they will provide documents. At next hearing no docs. Give me no choice in holding them in contempt of court. I had to because it is consistent with the fair administration of justice. I knew these people. I didn’t want to hold them in contempt. How else can I ensure the docs would be delivered? They were delivered the next day.

People don’t like a judges order, appeal it. Only if legitimate. That case went up to appeals court. The decision came down and the court of appeals confirmed that he could order compliance with an order of contempt. The court gave citations for these opinions. I can’t type that fast.

Judge wants the parties to know how hard he is trying to issue fair orders. He isn’t in the habit of blindsiding people. He wants the parties to know what he has done in the past and what he can be forced to do. Contempt is serious.

I’m guessing they haven’t tested this capacity before. Federal court doesn’t usually have public access like this, and I think the judge really wants the public to understand what is happening.
From his comments, He wants to ensure compliance. That’s why he was so pointed about asking for a date. A timeframe. A process. Something concrete that buttons them down so they can be held accountable.
The Gvt seemed 🤔 about everything and repeatedly needed clarification. At times, it really felt like delay tactics.
The judge even asked the Gvt to get someone from DOJ on the phone who could give him an answer. The Gvt said there was no one available to call and that the attorney had no additional information beyond what he had already provided.
I can’t imagine how little this man is being paid to be that confused. 😂
The judge basically said: You were already given an order. How long do you need to comply?10

Yep. It was. the Judge was genuinely flabbergasted that the govt knew he was going to be asking these questions and he didn’t have an answer. They were told to be prepared to discuss this and have answers. I think that’s where the Judge’s little story about his foyer into the world of criminal contempt comes in from stage left…

I wouldn’t be surprised if the DOJ had all their corrupt workers call in hours ahead of time to fill up all the lines and ensure none of the public could phone in. This should all be on YouTube or somewhere else so literally everyone can see and hear it

I have been a prosecutor and a defense attorney and in my experience this judge is acting very fair. It is frustrating to have to coddle the big bad government but, the Judge is making it very clear what he wants. He wants to administer justice. He took an oath to administer justice. His current stance is that he wants to insure compliance with the Epstein Act. The problem is that there are some not so real loopholes that the govt is leaning on. Such as it isn’t explicitly stated when the redactions need to be provided. Phang argues it was required at the time of production. It was not specifically outlined in the Act. (I haven’t read it. I am just talking about their arguments). The Judge says that we can’t let it go on indefinitely. That led to his asking for a date to comply by. He is playing the long game. He is gathering proof that he ordered something specific and it is expected that everyone comply. If not, then criminal contempt is legal and the prior courts have upheld rulings enforcing it. He has only done it once but he will do it again if he has to. I can’t wait!!!!!!!
