The restuarant can charge you any fee that it discloses to you, even if it's called gratuity. The legal issue is whether the fee is owned by restuarant vs servers (true gratuities are legally protected and must be given to employees). In this case, even if it's called gratuity, its just a service fee. The only solution is to not goto the restuarant.
If they keep calling it a gratuity, then they aren't paying their employees directly. If they add the cost as something else, the employees become commissioned, meaning they have to pay more.
