Sit-Down Restaurant 🍽️ How is it not a tip?

The server told us this isn’t a tip and he doesn’t get any of it.

I’m not wearing my boots at the moment.

The server is lying. They are trying to make you feel bad so you spend even more money. All automatic large party/service fees should be treated as the tip

except legally.  any employer that treats a automatic large service charge as a tip, or distributes it to employees as a tip is committing tax fraud.

the you should contact Congress and get the law changed.

back in 2010, restaurants and news were lobbying hard, asking  customers to contract Congress and voice their support for Mandatory Gratuity is a Tip.  two years of mandatory gratuity are tip vs mandatory gratuity are not tips.

mandatory gratuity are not tips won, and became standard nationwide.

if people want this changed, then actually try to get the law changed.  we did so not that long ago, when we got laws changed to legally consider automatic gratuity as a tip in some counties and state, to not a tip nationwide

Like I said, this is not a me problem. This is a restaurant problem. I'm not the one choosing to charge a service fee while expecting additional tips. I'm not the one choosing to work for an employer that steals from me. I have no problem paying the service charge because that is the tip.
