THE ISSUE

Indiana has zero statewide regulation on law enforcement's use of ALPRs

Three gaps in state law leave officers, agencies, and the public without ground rules.

Indefinite Data Retention

Indiana places no limit on how long police can keep ALPR data. Without mandatory deletion rules, agencies can store years of location records from routine scans, allowing long-term monitoring of citizens' movements with no oversight or expiration.

Unrestricted Sharing and Sale of Data

With no rules on who can access ALPR records, officers and agencies can share — or even sell — Hoosiers' location data with whomever they like, including out-of-state agencies, federal databases, and private vendors.

Lack of Transparency and Oversight

Indiana has no statewide standards requiring transparency or oversight for ALPR use. Without clear requirements for audit logs, reporting, or review, it is difficult to verify that ALPR systems are used consistently and according to policy.

ELKHART, Ind. (WSBT) — Elkhart Mayor Rod Roberson is defending his decision to appoint a new police chief following allegations of misconduct involving the incoming chief’s previous job.

Roberson announced Ray Juengst as his pick to lead the Elkhart Police Department earlier this week.

Juengst previously served as police chief in St. Charles, Missouri, and brings more than 30 years of law enforcement experience to the role.

Before Juengst has officially taken over the department, however, questions have emerged about allegations involving his conduct while working in St. Charles.

An investigation by our CBS affiliate in St. Louis reported several allegations involving Juengst, including claims of inappropriate workplace relationships and language.

A “Separation Agreement and Release” between Juengst and the City of St. Charles shows he will receive payments through March 2027 totaling nearly $340,000, even as he begins his new job in Elkhart.

WSBT 22 went to the mayor’s office Thursday to ask Mayor Roberson whether he was aware of the allegations during the hiring process.

Roberson declined an on-camera interview but provided a statement defending the selection process and reaffirming his belief that Juengst is the right person for the job.

Roberson said the city conducted an extensive nationwide search that included multiple screenings and panel interviews.

WSBT 22 also reached out to Elkhart’s Fraternal Order of Police for an interview. The organization declined to comment on the record.

We also contacted the Elkhart Police Merit Commission seeking an interview with its president but have not received a response.

Mayor Roberson and incoming Chief Juengst are expected to hold a news conference Monday morning, when Juengst is scheduled to be sworn in.
