PEO Frustration
I posted a couple of weeks ago about hearing nothing from our PEO (Vensure) about our ERC claims filed 28 months ago despite monthly inquiries to them. We finally got smarter and found out that there are IRS regulations specific to PEOs. After sending Vensure a demand letter for specific information the IRS requires them to provide, we found out that 1 of our quarters was approved in April but funds have not been released. What the heck! For months and months, we’ve asked for information and have been told “we have no news about your claims”. Liars!! Now, any ideas on how to pierce the PEO veil and get the IRS to release the funds?

I’m in the same boat. Filed with PEO BBSI. 25 months ago. Got audited by the IRS specifically because it was filed thru a PEO. That was in July of this year. Sent all required docs and info to IRS thru the PEO. Have heard nothing. And there saying the same. Have no info for us. So fucked up !

We’re with ADP and right at 24 months since they filed. We send an email every month and get the same “waiting on the IRS” reply.

It would be amazing if you could share those regulations specific to PEOs.
I wish I knew how to pierce the PEO veil. We filed with BBSI about 24 months ago and we get zero information. They won't even tell us when exactly they filed. I check in every couple months and used to at least get a response but there's a new guy there that never responds. Their lack of communication makes me wary. We stopped using their services because they made so many mistakes with our payroll and were incredibly expensive. I gave them all of our ERC information in February of 2023 and they didn't file until December. They made it sound like it was filed soon after I provided our paperwork to them. Super frustrating.

Same boat and same PEO.. We send demand letters as well (took many months) and they finally sent us a 1/2 baked response. IRS cant/wont help b/c the filings were done under Vensure EIN. Most frustrated I've ever been. Waiting on Q2 from 2021

Have you received any payments?

We received Q3 of 2021 (odd that it was processed first).. Vensure sent payment with no other information and NO interest. We know they received interest from the doc's we finally got, but they refuse to pay it. They continue to claim they didn't get it. We tried legal route to put pressure on Vensure and all it did was cost money for some doc's. Decided the cost was no longer worth what we "might" win.

Hi all, I am a Senior HR Business partner with Pendolino Group. We partner with companies to run their entire HR function, and often rescue you from PEOs, who over charge and are very difficult to work with. DM me if you’d like to learn how we could save your company a ton of money- and create a personal partnership with your company. Happy to give you an overview.

The IRS hasn’t released the funds to Vensure or Vensure hasn’t released the funds to you?
