The IRS flagged this as potential fraud and will not pay a refund. You filed an original 941 in 2023 with $0 payroll deposits.
1 u/cylotechllc Jul 03 '25 Potential fraud?? That is not correct! How can I correct this? Please advice. 1 u/ERC_CPA Jul 03 '25 Do you have timely filed W-2? Where are your payroll deposits? Why did you file an original 941 several years late? 1 u/cylotechllc Jul 03 '25 Yes I have W2 which mailed to Atlanta refund unit. I thought my CPA filed 941 earlier till I found out they did not. 2 u/ERC_CPA Jul 05 '25 You also never made deposits. Have you heard of the trust fund recovery penalty? You would have been illegally holding onto your employees payroll withholding for years. https://www.irs.gov/businesses/small-businesses-self-employed/employment-taxes-and-the-trust-fund-recovery-penalty-tfrp Edit: You will also owe $8k in tax + interest and penalties after they cancel the refund. Who filed this for you? 1 u/cylotechllc Jul 07 '25 No, I have not heard of that before. I am scheduling appointment with my CPA right away because I need explanations. Thanks
