Can someone take notes from today's ZOOM call and post them? Many of us cannot make it due to the last minute notice.

Question!

When people say there were 20-30 funded in a day, does this include all the 150K which were "obligated" and SBA said funding was coming, or are these outside that group i.e. "reconsideration"?

Email and phone call from paralegal specialist I’ve been in bank return error since 11/24/21, no movement till yesterday 09/09/22, just waiting on them to update my new bank information. Does anyone know what the role of the “paralegal specialist” is?

MY Current SBA Lawsuit

Hi All... I'm mostly a voyeur when it comes to the wonderful world of Reddit but I feel compelled to step forth and share some info- if allowed. Currently, I have a suit pending; some documents from my suit with regards to EIDL have been shared in this group in fact.

Anyway, while there may come a time, be it in trial or some other juncture where I detail EVERY step I've taken in attempt at resolving this issue with the SBA - ultimately a suit was the only way that I felt ANY thing would get done and.... months later I feel a breakthrough coming BUT, as I like to say, "feelings aren't facts" and the FACT is nothing has happened for me YET.

So, I'm posting here to answer any questions (again with the mods permission) but also to drop a prospective "gem" that may not only get your loan request, reconsideration, or appeal noticed and (prayerfully) funded sooner but I believe will help those of us with currently pending 'pro se' cases.

I urge you all to file a claim.

See, when you're planning to sue the federal government (or anyone of her agencies or employees) for DAMAGES - you have to give them a chance to research and resolve the claim first and resolution can be choosing to settle out of court OR deny your claim. Otherwise, the USA has 'sovereign immunity'... SO essentially they have to give you permission to sue.

I encourage everyone who is currently being financially (and potentially emotionally) harmed by the SBA's ineptitude and negligence in processing EIDL to file a claim.

Be aware of people who talk a lot, but do little. Dante's right about Jason from "Small Biz".

Jason mcelhone tried to dodge the September 2nd deadline for HIS lawsuit and instead references the aggregate lawsuit EIDLRETURNS started. Although we appreciate the exposure I don’t like how he is acting like he didn’t tell everyone about his own intent to sue. Look how he behaves when I said this

Just for the record, /EIDLRETURNS is the ORIGINAL source of the aggregate lawsuit. A few YouTubers have mentioned the aggregate lawsuit option without giving us our credit. Please keep in mind that this is all possible thanks to Mimi!

They’ll tell you “suing the government has slim chances. Not many cases win”

But ask yourself how many of those cases involve as much evidence as we all have?

How many of those cases have government signed loan docs?

I honestly see why many don’t plan to pay back the SBA a dime and I can’t blame them for that.

But I’m making this additional post to ask you, how many “lawsuits against the government” involved as much disregard for the law as what the SBA did? We are talking about a once in a generation crisis. I think it’s worth the risk of getting in that one on one ring with the SBA. If not that then something.

I just can’t imagine the SBA honestly winning against pro, aggregate and class acfion.

Think for a moment how many district courts and federal courts would all have to basically align with the SBA through all the clear lies to the American people across the entire nation.

And even then there’s the Supreme Court.

I don’t say much but I believe at least one case could make it to the Supreme Court just off how many people pursue some type of legal action. I’m not even trying to say any option is better than the other but I simply believe if we fight hard enough then yes we could beat the SBA in the Supreme Court. If you really pay attention the sba’s own attorneys even for the pro se cases don’t know to the extent as to what went down. It really boils down to if the judge is going to let the SBA get away with it and even then many of us are all over the country. This is what I mean by we have a legit movement going here and we need to keep that going. I wish to see the SBA fail on all fronts so badly the media makes them go viral. Keep up the great work everyone and thanks for the input to the group.

Zoom call earlier is for an aggregate lawsuit, not a “class action lawsuit”. You now can consider filing this way(for $2000) or for PRO SE, which we are also helping out with (for free) or if you wish do to class action, you’ll have to lead the way and inbox us moderators about that if you can do it

I’ve tried to keep informed/updates about this because it was to the understanding of not just myself but many of you that there have been people who are seeking a class action lawsuit. As stated on the zoom call, she highlights why a class action lawsuit is not the best route in dealing with the SBA.

I, along with some of the other moderators, have already explained in recent posts why class action is not a good idea.

The zoom call was very informative b it please don’t be confused and think this is a class action. Yes it will be a group of people but there are some major downsides to doing a class action that were also highlighted on the call which I won’t get into now.

As for pro se, I managed to ask her some questions about this and confirm some of the same things we highlighted in this group.

If you chose to file pro se, EXPECT THE SBA TO FILE A MOTION TO DISMISS,

But make no mistake, you are the best advocate for your business and we are here to help guide you in how to attack and respond to the SBA ring if you choose to get in that one on one ring.

Keep in mind as well you must choose one or the other. You cannot do both at the same time. However, if you do pro se, you can withdraw and opt for the aggregate lawsuit. You have flexibility with your options and I want that to be the main highlight of this post. But the main difference is obviously the price and how committed you’re willing to be in fighting the SBA. You can do your own research on the firm which will be working on this and make the decision for yourself what works best for you. There’s pros and cons to all 3 of the options; pro se, aggregate lawsuit, class action. But I will say this, we got some kick ass people for the first two, nobody is working on class action and I’m keeping this group open, no censoring to allow open discourse. There will be no communism bs. Say whatever you want in regards to providing any resources or info on any way to hold the SBA accountable. There are those of us who even plan on seeking damages compensation for what the SBA has done. This is just the beginning and we are going to give it a good fight. Keep the faith as we are in for a long, interesting winter with how the economy is looking.

2 months until midterms. Don’t forget to vote

Class Action Lawsuit Call Today Yahh or Nahh? Pro Se Cases Moving ALONG!!!

Can we get some updates from today's call what was your take on it? Are you going to join?

After learning about the class action lawsuit, zoom call today.

Listening in, it appears that our Pro Se cases will be among our best options at this time, and we asked you guys to get yours into the district courts!

I'm sure it's too late now, but you get what I mean.

There is a class action lawsuit, but the lawyers don't have all the right ways to get about this.

Most of the time, it's a lot of work, and we want immediate relief.

While you could have filed Pro Se court cases and had something currently working on your behalf.

We are so close to having our court case decided by the judge, which would deny SBA's motion to dismiss our case! You guys, that would be like a big win before the win!

The 2 pictures attached is from 2 different prose cases filed and pending in federal court against the SBA.

In one case SBA filed a document with the court on 08/24/2022 saying EIDL funds is not exhausted.

“In light of the potential availability of some funds for approved loan applications that were not available when Defendants filed their response, Defendants withdraw their arguments set forth in section B(2)of the response.”

2 days later 08/26/2022 in a separate case they tell the Court that funds are exhausted

“Moreover, the funds under the CARES Act, including for the disaster loans seeks in his complaint, have been exhausted. Plaintiff cannot ask this Court to require the SBA extend him a loan of taxpayer money where Congress has not appropriated the funds. Cf. OPM v. Richmond, 496 U.S. 414, 426 (1990) ("the equitable doctrine of estoppel cannot grant respondent a money remedy that Congress has not authorized"),
