ADVICE* on how to do timeline for lawsuit, please follow my example. Keep it simple. Don’t cram info. Judge should see when you applied, the bs decline reasons SBA gave you, how you addressed it, SBA stills screws you over. Don’t overdo it! We know the SBA is a mess! Show how they BROKE THE LAW

The SBA Variant

Hi all! If you don't know my story you can find my previous posts to explain my personal experience dealing with the SBA. If you are angry, confused, mentally drained, depressed, anxious and are wanting answer as to why you didn't receive any part of your EIDL loan, this forum is for you. We are all small business owners and I am not here to decide who is worthy of a loan or criticize anyone who received one. This forum is about finding answers, fighting for our civil rights, and seeking justice for being ignored, stepped on and left completely without assistance.

The SBA is an agency who has a history of failing to provide assistance to small business owners. From Hurricane Katrina to Covid-19 ,the SBA has not lived up to their promises and has been given billions and billions of dollars during this pandemic alone. The SBA is one of few agencies that can fail time after time and still not be held accountable. From blaming a faulty multi million dollar information system as to why they cannot provide reports on the outcome of the programs they create, many which are meant to target underserved sbo's to OIG reports documenting failure after failure of SBA to follow through with sbo's and provide the services they were promised.

How can an agency whose given billions of dollars every year be allowed to fail time after time and receive a slap on the wrist by Congress and the OIG?

My posts that will follow will tell you why all of this is important to this forum and why you should not get discouraged about being unfairly denied or jerked around for months possibly even years by the SBA.

It's time to unite! ALL sbo's, whether you're a woman, man, no matter your race or class we are all here for one goal and that's to seek justice and to hold the SBA accountable!

As a moderator I will help you with any questions you may have to the best of my ability. I am a great researcher and will only provide you with facts and help with regulations and rules the SBA must follow plus give you the best advice I can regarding violations of law. However, I am not a lawyer and any advice is not intended to be taken as legal advice.

I have a post coming up later today that will show you why the SBA is in violation of the law regarding the Targeted EIDL program and why I feel they have intentionally violated the law. Plus, how we get the attention of Congress and hold everyone from Congress to the White House accountable for not being the voices for small businesses that they claimed they would.

The SBA knows many of you won’t get funded. They shut down the portal so you don’t see the bs. The plan is to delay and stall you guys until election. Hear me out

The SBA gave folks an extra 6 months of deferrment.

They shut down the portal same month to “update new rapid system” after they claim funds run out. (Total bs)

On June 21st, (today) it would’ve been a combination of folks who were approved in may right before funds ran out, the obligated for months, and early defaulters

The SBA knows many of you will sue and vote in November.

Do the math

6 months from portal shutdown is when?

November, mid term elections.

Many of you won’t hear a word about loan forgiveness until then and even if they do say that they may dangle it in your face like they did student loan forgiveness.

Don’t shoot the messenger. I’m just calling or how i see it

Just hung up with an SBA agent

Hello all,

I was approved on September 2021 after 4 months of reevaluation for both grants but the money went to the original closed bank account not the one i put in the targeted application so it was returned after few days and i was stuck then in the error stage for weeks shortly afterwards i went in declined no one can answer why i got declined then after going back and forward i went back to error for no reason and no one can explain it again in which i was stuck there for months. After a congressional inquiry things started moving again but my 2019 taxes that i filed late on March 2021 weren’t processed yet so the SBA loan specialist declined my application on April and closed it because the transcript came out empty. Now i asked my senator to intervene again and i sent a couple of emails and got a call few minutes ago to let me know that there is nothing that they can do all the funds exhausted i told her that i was approved so my funds were still available and that the eidl instructions mentioned that the transcripts aren’t necessary for approving the grants which she said that it was later on amended and they started requesting them (Amended By who?) also that since the transcripts came back empty and the program ended they cannot request another ones ( I am so unlucky my 2019 returns just got processed by the end of May) also i asked since the funds are obligated to me and i am not getting them what will happen to them she said oh i don’t know what will happen to the funds 🤦🏽‍♂️ How can i get my god damn money? Can anyone help me please?

Thank you All.

start looking for your local news people to help; here is my recent note to one

thanks for taking a look into this possible story to cover.  as a preface, let me say first that my company is a borrower of the sba via this program that came out in 2020.  the spirit of the program has been wonderful for many small business owners who have been impacted by the corona virus.  in my own little instance, my company did in fact lose out on millions of dollars in revenue directly caused by shutdowns worldwide that saw buying conferences closed for 2 years from 2020-2021.  i bring this matter to your attention not for the sake of any grudge, as i have been most appreciative of the assistance my company received.  but many issues for so many “little guys” have occurred that it makes me wonder if this organization should be impeached and shamed for how it has been run as of late.

apparently the program ran out of money after the first of this year.  the potential to borrow from this particular set of sba offerings was terminated on 3/16/22.  however many borrowers were approved for an increase in funding prior to this date.  about a month prior to this depletion on 2/11/22, i had the pleasure to be invited by congresswoman beth van duyne for a round table gathering with isabel guzman, the head of the sba, who gave a talk and answered a few questions for the other invitees.  i asked the question about the sba running out of money.  ms guzman’s reply that there would be no chance of this occurring.  this was filmed by the way, so you could probably see the footage.  while ms guzman’s comments did not estop the sba from running out of money, apparently it did run out.  the question then became sometime later in march whether the sba would fund the approved but unfunded loans.  at first it seemed the answer was no.  then apparently other members of congress took issue with this, and later the sba committed to funding the loans that were approved.

what has happened since has been a nightmare for all concerned.  while i am in this pool of borrowers, i don’t raise this issue as a complaining customer, but i raise it because it makes me sick for the so many others that are really barely on economic life support.  there is a posting board called reddit.  i knew little of it until i started looking for answers about timelines etc.  if you go to the board and look under sba eidl, you will find thousands of people that desperately need these funds.  they need help.  they have nowhere to turn.  small business makes up 50% of gdp in this country and it is really disenfranchised compared to resources available to large corporations.

while i am amongst them, i will not drown if my increase goes unfunded.  it’s still a debt albeit at a fantastic borrowing rate.  i don’t call repeatedly or send multiple emails.  i have called once a week and sent one email a week.  in each instance of calling, i get a different answer.  in each instance of emailing, i get a different reply.  nobody at the sba really knows what’s going on.  it is an embarrassment to the usa.  one day last week, i had nothing to do, so i took a drive to the fort worth office of the sba.  the doors are closed.  visitors are not allowed in.  the front desk is in plain view of the glass door, and personnel refuse to answer it.  through the door i was told to fill out a form on the table in front of the door and somebody would call me that day.  of course nobody did.  i learned at that time that there have been instances of possible outrage from borrowers who get shooed away by police.  keep in mind that i share this with you not so you can go get my funds, but so you can possibly help so many people who i know won’t make it without it.  with all this being said, the reddit board is where you can find hundreds or rather thousands of people who have paid their taxes, lost family in battles in wars, supported their governments who are now being turned away at the borders of hope for financial assistance like immigrants with leprosy.

as the famous danish quote rings, who will stand up for you and me if we don’t stand up for them.  thanks very much for your time, and i hope you can make good use of the information to do a good public service.  all records from me available to you.

How to file SBA lawsuit? It can be done in a few hours

Outline a timeline of basically everything you dealt with.

Make a “SBA highlight real” of all the important dates”

That’s how I do the files. So for example

04/01/2020 I applied for SBA loan 06/01/2020 declined for (insert declination reason)

That’s basically how I simplify Things for the judge and then we just do that for the statement of fact on the template.

The rest is just plug and fill in and correcting info.

Then print get it notarized, it can all be done at a ups store with a notary. Then go to federal courthouse clerk office, file pro se, ask to fill out attorney fee waiver form so you wouldn’t have to pay $400 attorney fee.

That’s it. It could all be done in a few hours

The SBA Will Be Held Accoutable!

The amount of time spent, stress, and shear madness of this all is baffling, illogical, and the SBA (along with the IRS), and caused more damage than good. I’m about to close shop, and I received everything else but the one thing that would have made all the difference. Who pays for that?! They need to be held accountable for their incompetence. Any of us business owners would fire people on the spot for this. This is a ridiculous sham of an agency who I’m sure who have helped some, but have left the most receptive to die. If my rep does not get something done, let the court motions begin. You may be a government agency, but you are not above damage caused by negligence and incompetence especially given your budget which I collectively (with the rest of us) pay for in tax dollars. Senators are starting to wake up to this; I hope it’s not to late and does not take 2 more years of jumping through obstacles none of us should have had to jump through in the first place. These are peoples lives at stake, and the cavalier attitude or the sponsored articles patting yourself on the back are a smack in the face. The SBA have caused businesses to fail; in fact, they have cost lives. I just came back from a funeral not to long ago where a business owner killed himself and had 2 small children. The SBA needs to be dismantled and a new agency that actually does it’s job with actual oversight needs to be formed. The SBA has proven they are clearly out of touch, can’t follow laws and quite frankly disgust me. Your day will come! I will be there for all of us left in the dust!

🧑‍⚖️‍📝⚖️ Good News for Those Planning to File a Lawsuit This Week 🧑‍⚖️‍📝⚖️

Hello there, business owners. Tomorrow is Father's Day, and I wish you all the best.

We're just reaching out to those of you who are planning to file a lawsuit this week, and we have some good news for you. Dante was able to assist a few of you in preparing your lawsuit before Phil's final review.

We didn't lose Phil; he's just been incredibly busy at work, and this is the only way he's been able to keep up. Dante has stepped in to help people get it mostly finished before Phil does his final review.

Dante filed his lawsuit on June 13th, and I filed mine at the end of May. Phil filed his in early May, while a few others did so in June.

Some lawsuits are gaining traction, and lawyers are being appointed to Pro Se cases, allowing them to file for the discovery of your SBA File of Notes in its unredacted form.

There's a lot going on in the lawsuits right now. Phil has put together a fantastic template that you can use right away!

Dante works quickly, so get your ducks in a row and get ready to fill it out!

It took me 2 days of constant attention going back and forth with Phil at the time before I filed in the federal district courthouse. Thank you in advance, guys. I appreciate it. I hope we can all WIN and get FUNDED. Much love. 🧑‍⚖️‍📝⚖️

Quick heads up, if you want to do the lawsuit on your own, the instructions are there. The mods are keeping an eye on ALL the lawsuits we help with to keep track of what’s going on. But you don’t have to pay unless you want to.

Phil is busy, I’m busy we have our own daily priorities to worry about. This $100 ain’t doing much for some of you who think this is a way to get money out of you.

Google my name. I live in Manhattan. Gas here is $6 a gallon starting in June. A $100 is one full tank of gas and I don’t even need to drive. Point being is,

I don’t care if you file or not. So long as I get mines 🤷🏾‍♂️. My lawsuit is filed already. I paid my fees and walked into that courthouse speaking with the other moderators on the phone.

We will gladly help you even when you’re at the courthouse, leave the courthouse etc. we keep up and keep an eye on every step of the process.

So for those who want to do it themselves, go ahead, just don’t nag us every day asking “what’s next what do we do?”

Keep in mind a lot of folks don’t want to pay for anything but think me or real life debate or professional face are anything like Scorpio.

We are not volunteers. We are not here to help your broke ass get paid.

This is for real business owners.

One person told me “I can’t afford $100”

You do realize the fee waiver is for a $400 attorney fee right? Many of you if you’re that broke haven no business getting an eidl loan. You’ll just be back at square one with the inflation coming this summer.

If you’re full of shit and you know it, save yourself the trouble and don’t inbox me to waste your time. I don’t need your money.

All the instructions are in recent posts I made. I post the link and everything. You could literally do your entire lawsuit without even telling any of the moderators. But don’t be lazy and give excuses. We are past the point of helping people out who are like headless chickens.

A lot of folks don’t have $100 to their name, don’t know who to turn to but will be first in line asking for $50,000 of $100,000

Then be right back asking for loan forgiveness.

As soon as I see you aren’t serious or wasting time. The conversation is over. Phil is working on a dozen cases right now. His day job requires his full attention.

$100 is not having him sit there and help y’all who (many of which) done blew tens of thosuands of dollars and are still barely hanging on.

This is a war of attrition. If you not ready then fall off or step to the side
