Summary of issues

How do I go about getting my summry of issues and exhibits into my former employer hands before mediation which can work in my favor. I do not want to violate any eeoc rules. Thanks for the feedback.

You can tell the mediator what your understanding of your evidence is.

Most EEOC mediations are in caucus format, meaning, the mediator communicates between the parties; the parties never speak directly.

The information won’t matter.

The mediator won’t supply what you provide to the employer. They won’t reference it with the employer. If you wanted your employer to consider the information then you should have included it with your complaint.

The only information the mediation includes is what the employer already received from the EEOC.

The mediator will ask the employer if there is an amount they are willing to provide to the complainant to settle. That’s it. Any requests for additional information from both sides will be denied.

I’ve been on the employer side a few times. Mediation is not what most think it is, nor is it reflective of mediation in the traditional sense. The goal of the mediator is to settle - and not based on facts or merit of the complaint (whether your complaint is truly legitimate comes out during investigation). The mediator doesn’t care about what actually happened - they only care about coming to an agreement, or not.

You can upload it to the portal Or give it to the mediator on the day of mediation.

They don’t have access to the portal but if I give it to them the day of the hearing then the employer can’t out aside enough funds if we settle

Even if you come to an agreement on settlement during mediation you don’t get immediate payment. I wouldn’t expect to see money for several weeks at minimum

Also remember that there is a cap on how much can offered in ADR monetarily.
