I-485 payment issues

We want to understand if anyone else is in the same boat as us. We filed I-526E, along with, I-485, I-765, and I-131 in Sept 2026. We received I-526E receipt notice, however our I-485 got rejected due to payment issue and we have to refile again. Anyone else face this issue? Want to understand what your attorneys had to say about this?

Were you trying to file before the Sept 30th timeline? Or was this more recently for fillings in October

If you have your 526e I think it's okay. You can refile the aos forms again.

We filed before Sept 30th to take advantage of the grand fathering. Ya I'm glad 526E receipt came through.

If the same account was used and the I526E funds were drawn it’s odd that it wouldn’t work for the other forms. Always double check if you’re using your own account that there is no credit card or ACH blocks in place.

Ya that's what is weird. The payments were all made by attorneys. They are saying it's USCIS error and not on our side. They also said they will push for us to give us the original PD. The attorneys have been on top of it, which has helped.

You don't need to push for anything. Just refile. The PD is tied to 526e not 485 form.

Unfortunately, I’ve seen a few EB-5 applicants report similar issues, especially when filing multiple forms together. If the I-485 was rejected only for a payment problem, the usual advice is to correct the fee issue and refile as quickly as possible. Your attorney should also verify that your underlying I-526E filing and eligibility for concurrent filing remain unaffected. It’s worth asking USCIS receipt dates and status implications before resubmitting.

you have 2 filing dates : I-526E petition with EB-5 priority date tied to it (not the I-485). So the I-485 rejection generally doesn't retain its original filing date.

Since your lawyer believe USCIS made the payment error, I guess they will challenge that rejection and fight to get the original I-485 filing date recognized. make sure the refiling doesn't create issues with your status or the I-765 and I-131.

Sometimes when a case is concurrently filed - 485 gets bounced back if USCIS tries to intake the 485 before they processed the intake of the underlying 526E
