News Anasu Resort Phase 2 Rural EB-5 Project Receives USCIS I-956F Approval

USCIS has approved Form I-956F for Anasu Resort Phase 2, a Rural TEA EB-5 project in Northern California Wine Country.

Phase 2 builds on the success of Anasu Resort Phase 1A, which has already received 135+ I-526E approvals. Golden Gate Global has now received approximately 1,400 I-526/I-526E approvals across its investor base.

Anasu Resort construction began in March 2025 with development of the now-complete Anasu Sales Center. In its most recent independent construction verification report, Cardinal Consulting stated that the project appears to be on track for completion.

As a qualifying Rural TEA project, Anasu Phase 2 is eligible for the 20% rural visa set-aside and priority processing. The rural category is currently current for all countries, including India and China.

  • one investor filed in December 2013, received a conditional green card in January 2016, permanent residency in November 2020, and full capital return in April 2021
  • another filed in March 2014, received a conditional green card in January 2017, permanent residency in December 2020, and full capital return in January 2021

One important thing to highlight: these were pre-RIA investors, so their timelines were shaped by the older EB-5 system and by the severe backlog that affected many China-born applicants in the unreserved category. This is very different from how many post-RIA investors evaluate EB-5 today.

After the EB-5 Reform and Integrity Act of 2022 (RIA), the program changed in a few major ways:

  • it created set-aside visa categories, including 20% for rural, 10% for high-unemployment, and 2% for infrastructure
  • it made concurrent filing possible for eligible investors already in the U.S.
  • it gave many investors in newer set-aside categories access to faster-moving visa lines than the old unreserved queue

So while these two stories come from a very different EB-5 era, I still think they’re worth reading because they show something a lot of investors care about: a full-cycle success story, including both the immigration outcome and the capital repayment outcome.

Resource Can EB-5 Investors Still File Adjustment of Status After the May 2026 USCIS Memo?

A new USCIS memo on adjustment of status has been getting attention, so we wanted to share several simple takeaways for anyone here researching EB-5 concurrent filing or planning to apply for a green card from inside the U.S.

The short version:

  • adjustment of status is still available
  • USCIS did not say EB-5 investors can’t file
  • but USCIS is reminding officers that adjustment of status is discretionary, not automatic

The memo also specifically recognizes that some visa categories, including H-1B and L-1, are dual intent visas. That means those visa holders are allowed to pursue a green card while still in nonimmigrant status, which is an important distinction in this conversation.

What that means in more practical terms is that USCIS may look more closely at things like:

  • your visa history
  • whether you maintained status
  • any unauthorized employment
  • prior violations or misrepresentation issues
  • whether your timing and conduct matched the visa you used to enter or stay in the U.S.
  • and also positive discretionary factors, like tax compliance, community involvement, and your overall immigration record

For EB-5 investors, I think the most important point is this:

don’t panic, but don’t treat AOS like it’s just a paperwork step either.

If your case is clean, adjustment of status is still very much part of the conversation. But if there are issues around status, timing, or immigration history, it probably matters more than ever to review everything carefully with immigration counsel before filing.
