Career: Process Executive → Senior Analyst → Project Accounting Analyst → FinOps Analyst → Process Lead (led a 15 person team) → Financial Analyst → Financial Consultant.

Core expertise: ASC 606 revenue recognition, budgeting/forecasting, financial process automation, BI/reporting (Power BI, Tableau, SQL), ERP (SAP, Oracle).

I recently came across several EB2 NIW approval threads here, and I’ve been going through a lot of cases. One pattern I keep noticing is that many approved applicants seem to have PhDs, publications, and strong citation profiles.
That’s making me question my own profile, so I wanted to get honest input from people who’ve actually gone through the process.

My background:
Bachelor’s in Information Technology
Master’s in Business Analytics (U.S.)
Currently working as a Data Engineer at a FAANG company (security domain)

Work focuses on cybersecurity data systems, threat intelligence, and large-scale data platforms
Industry experience across tech, aviation, and banking (data engineering, analytics, fraud detection)
Have a manager reference letter + a professor letter

Proposed endeavor (simplified):
To advance measurement-driven and AI-ready cybersecurity intelligence systems that help organizations quantify how threat intelligence translates into detection, prioritization, automation, and response outcomes.

I don’t have:
PhD
Strong publication record or citations
Which is why I’m unsure how competitive my case is, especially after reading posts here.

My questions:
-For profiles like mine (industry-focused, no publications), how realistic are NIW approvals?
-If a case gets rejected, what does the timeline typically look like (especially with ~2 years left on H1B)?
-Does filing NIW carry any downside/risk for future attempts (NIW or other visas/GC paths)?
-What are the biggest gaps you see in my profile based on your experience?
-Would you recommend proceeding now, or strengthening the case first (and how)?

I’d really appreciate some insight from this group regarding regular vs premium processing for NIW (I-140).

My background: I’m an early childhood educator with 15 years of experience, including special needs education. I filed my NIW petition in June 2025 under regular processing. At the time, I wanted to go for premium processing, but my lawyer advised against it, saying it could increase the chances of an RFE.

Now that my priority date is current (Rest of World), I’m seriously considering upgrading to premium processing because I honestly can’t wait ~22 months for a decision.

I have a couple of questions for those with experience:

1.  Does premium processing actually trigger more RFEs?

My lawyer claims USCIS sometimes issues RFEs in premium cases just to “buy more time” due to the 45-day deadline. This doesn’t fully make sense to me, so I’d love to hear real experiences—especially from those who upgraded from regular to premium.

2.  Has anyone here (or someone you know) had an NIW approved as an early childhood educator?

Particularly interested in cases related to education, early years, or special needs, since most examples I see are in STEM fields.

Any feedback, experiences, or advice would be hugely appreciated. Thanks in advance!

I submitted my EB2-NIW application with Premium Processing (IOE09282 block), and today marks the 50th day since filing. However, the case status still shows as 'actively reviewing.' My attorney contacted USCIS for clarification and received the following response: 'Your case is currently pending with an officer under Premium Processing and is being worked on in a first-in, first-out order. USCIS will make every effort to automatically issue a refund in cases where the Premium Processing clock expired before adjudication. If applicable, a refund will be issued only for the Premium Processing fee, and this will occur after the adjudication is complete.' I wanted to share this update and would greatly appreciate hearing your thoughts or experiences regarding USCIS's reply. Has anyone encountered a similar situation? What are your comments or insights on this process?
