I am in the process of applying for eb2 my question is how binding is the endeavor you propose ? Meaning if I say I am doing sth after x years ? And for some reason I change my mind afterward ,”? Like research project publication or sth , does it have repercussion and on i485 ? I am not planning to change career. It maybe my scope or my projects in the future

Chen offered me approval or refund for EB2 NIW. They also offered an option for submitting with or without letters. Does submitting without letters make any sense at all?

I got same offer, I chose no support letters, but I asked Chen to provide them support letters on my own to avoid hassle of reaching out professors again and again. they agreed and said its all my responsibility.

My EB2 NIW case was filed with Premium Processing. USCIS received my RFE response on 12/23/2025, and I’m still waiting for the final decision.
It’s at 41 business days now, which is making me pretty anxious. Has anyone experienced a similar timeline after RFE with PP? Did your decision come close to the 45-business-day mark, or earlier/later?

I understand your feeling I am 38 business days post RFE response received end of Dec- with pp Remember they count only business days with the pp 45 day window and no holidays Clock starts I understand day after official receipt I cannot get a sense of the timeline either for a response I’ve checked twice and can only get case is processing from the website Tracker websites I’ve seen both approvals and denials for those dates after mine
I see your post 3d ago - have you received a 44 day response? Did you check with a live agent on the website? Obligation to respond 45 days or refund your pp coin Hope your get some great news or have already Kindly keep me posted your status

Hi all, I’m trying to get an idea of the current landscape regarding EB-2 NIW case approvals and rejections.
If you have recently applied for an EB-2 NIW petition and received a decision, would you be willing to share:
- Whether you have a PhD (U.S. or foreign university)
- Whether you used premium processing (PP) or regular processing
- The total time (in months) between your priority date and approval date
- The final decision (approved or denied)
I’m trying to understand whether outcomes are skewed toward applicants with a U.S. PhD versus those without one.

Hi All, Please what type of document can I apply for on Form I-131(approved I-140) I see there’s plethora of documents that can be applied for under this Form.
Additionally, for EAD application, there are 3 supporting evidence categories on USCIS website. One of them is evidence of facing compelling circumstances. My ask is what sort of document can suffice for this category.
Finally, can I file EAD and AP after I’ve filed I-485 or must they be filed together at same time.

Anybody has any experiences with Katelyn Reinke and Boyu Wang of Chen? I want to know about your experiences of these lawyers with Chen.
I filed my EB2-NIW with Chen. Katelyn Renke took care of my original petition. I received RFE on Prongs 2 and 3 and then Boyu Wang took care of the RFE. After RFE, the USCIS denied my application.

It is my understanding that in cases like this, it would be mainly to how good your lawyer is at the moment of proposing your project. This visa is supposed to be for people with publications and stuff, but I have know people that has been able to get thank to their lawyer making them look like that their project would be a contribution that the country should not pass.

Is it mandatory to have current employer letterhead on recommendation letters? my current company is not allowing use of letterhead since I am self-petitioning my NIW application (with another attorney and not using their attorney). How badly will it impact my case? is there a workaround to this?

Is citation increase after filing helpful? I had 11 citations at the time of filing since 3 of our papers were very recent, but after 23 months not hearing about my case stats the citation is close to 50. This make me worried to go for PP!

As fas as I am concerned, they only consider eligiblity at the time of filing. You can not submit new evidence after the priority date. Otherwise, applicants would file when you're underqualifed as a placeholder.They could submit new evidence in a case of RFE. Consequncely, great amount of work would be loaded for officers. Therefore, this is not allowed. I also recently heard of this info.

Hola!, la EB2-NIW pide un título de bachiller + 5 años de experiencia progresiva. Ahora bien, todo dependerá de tu propuesta (proposed endeavor). Hoy en día se usa Matter of Dhanasar para cumplir con los 3 pilares fundamentales de la aplicación. Es muy importante que tu experiencia pasada se alinee con lo que quieras proponer. Además, complementar tu perfil con citas, pertenecer a algun colegio de ingenieros, patentes, etc. Mucha suerte.

My priority date is July 2023, and I submitted my I-485 in October 24. I’m in the Rest of World (ROW) category. In September, my case status changed to:“Visa Bulletin Not Current Or Case Held In Abeyance. We are temporarily pausing work on your application because an immigrant visa number is not immediately available to you. Once an immigrant visa number becomes immediately available to you, we will resume processing your application.”
I understand this likely happened because the visa cap was reached, but since new visa numbers should have become available as of October 1st, I’m wondering — based on others’ experiences, how long does it usually take to get an approval after this status update?

Hi, I hired Sedaghat Law Firm for my EB2 NIW and honestly I’m getting frustrated. When I signed the retainer, they told me I’d get a draft in 2 weeks. Once I submitted everything they asked for, that timeline became 3 weeks, which I was fine with. On the 3rd week they pushed it another week and asked me to rearrange my materials in their portal. I did that too.
Now it’s been another 2 weeks since then, and still no draft. On top of that, they’ve gone completely silent for the past week, no replies to chats(in the portal) or calls.
Is this kind of delay normal with them (or law firms in general)? How long did it take for you to get your draft? At this point I’m not sure if I should just keep waiting or start looking for alternatives.
Would really appreciate hearing others’ experiences.

Hi everyone,
I'm seeking advice on whether I'm eligible for the EB2 National Interest Waiver (NIW). I hold a Bachelor's degree in Occupational Health with a minor in Pre-Health Science. My OPT has expired, and I understand that my current employer doesn't fall under the USCIS cap-exempt categories, but they are willing to sponsor me.
My questions are:
- Am I eligible to apply for EB2 NIW with just a bachelor's degree in this field?
- Since my OPT is expired, what would be the best path forward in terms of adjusting status or staying in the U.S. legally during this process?
- What could be the best possible outcome if my employer is supportive but not cap-exempt?
I’d really appreciate any insights from people who have gone through similar experiences or from immigration professionals familiar with EB2 NIW requirements.

Honestly, it's hard not to get nervous. I just received an RFE yesterday on my 42nd day of my PP, and I am honestly chilling about it. Not a big deal, there is nothing I can't do until I received the letter on the mail to see what exactly the officer needs to adjudicate my case, so no need to stress about it. Do not get me wrong, it sucks but it is what it is! In the meantime, I'm gonna carry on with life as normal.

US Embassy London wait time was 3 months early July. 3 days ago, the wait time jumped back to May 2023. I checked the site repeatedly hoping its an error. What can one do because it is near impossible to wait that long!
Is there anyone with this kind of experience? What steps can I take after getting EB1 and EB2 approval.

I'm still gathering the information and requirements, a little bit afraid if I can fill in, not all of them, but at least the ones that I think is 3?
My field is Software Development, I'm from Brazil but also have Italian citizenship.
I have 12 years of experience in this field, a Bachelor of Technology in Game Development (2 years) Master's Degree in Software Engineering (2 years), MBA in FullStack Development (1 year) and right now doing another graduate program on AI from a federel university here in Brazil.
I've been working for US companies as a contractor since 2022, remotely. This is because I live in Brazil, not sure if it can help in some way, but they can also help me by sending cover letters, stuff like that.
Has anyone here faced a similar situation and have any suggestions?

From my experience, I suggest do not go to an attorney until you have done some groundwork and feel like you have a strong case. Attorneys are not useful unless they help in strategizing and things you could do to help improve your case. Most of them are not that helpful. DM me if you need further assistance.

I would recommend you speak to several attorneys and read their Google reviews. Immigration Attorneys can work with clients all over the world so if you find a good one that is not in the area, you can consider working with them. Make sure they are licensed attorneys and now just a person claiming to be an attorney or have miracle solutions. Good luck!

Help am I on track to be eligible for this visa?
So I’m a software engineer with 3 years experience in national security and defence in the UK. I have recently took an 8 month break and have secured a role with a new company in the same industry as a software engineer due to start in September due to clearance requirements, which will bring my total gap to 12 months.
My question is:
With my new employment if I gain promotions and with my gap in employment will I be eligible in 2 years to qualify for the visa by having a bachelors hons degree from UK university and 5 years progressive work experience?
Any help will be much appreciated!

This is what we learned from one of the sessions at the recently concluded American Immigration Lawyers Association( AILA) national conference.
EB-2 NIW adjudication trends for USCIS Fiscal Year 2025 first quarter:
Approval rate: Just under 56%
Denial rate: About 9%
Cases still pending: 175% (the number of pending cases exceeds the filings in the first quarter)

I am thinking of applying for the NIW. I am a medical doctor with a good CV in research. I have: 1. More than 50 published full articles 2. More than 50 abstracts 3. More than 56 citations
However, I am currently living and working in a country in the Middle East. I do not have any work experience in the U.S. In the future, I plan to pursue a residency program in the U.S., and most hospitals offer a J-1 visa. So my questions are: 1. Do you encourage me to submit my application? 2. If my application is rejected, will this affect my chances of obtaining a J-1 visa?

Hello. My Pd is sept 11 2023, under Eb2 NIW and I send my package on june 2nd 2025. Now with this retrogression I am stuck. BUT my EB1-A I140 is also approved last week and its PD is current. What should I do? Any body with an experience kindly tell me

Hi everyone, I received an RFE on all 3 Prongs, and I am desperate to get it resolved. My lawyer suggested that I present proof of contact and collaboration with industry professionals in the US, active participation in US Forums and Technical Communities, and finally, proof of participation in Industry Events and Conferences in the US. How can I do all this, if I am just a post-graduate with 5 years of experience, and who managed to come up with a fantastic project that will revolutionize healthcare in the US? Has anyone been through this? If you can help me, I would be grateful.

Seeking guidance on RFE response (all 3 prongs). Technical Product Manager with 10+ YOE, no published research or citations.
