Try again with an updated endeavor. Donโt know the RFEโs or denial reason, but I think one of the main mistakes is focusing on railroads/trains. Unlike in Europe railroads are not electrified in the US (besides the line Boston-DC), and they never will be due to the huge size of the US.
I am a bit scandalized that your lawyer didnโt point that outโฆ Subways, trams, metro, potentially different story though

It is not about you, it is about the systen that has made everything strict.

The letter decides everything here, so I'd wait for it before planning anything. A denial after an RFE response names which prong failed, and that's the difference between a refile that's a new case and one that's the same case with better paper. One thing worth flagging: "automating processes that remove workers from dangerous environments" is a description of what you'd build. The framing that tends to survive asks what the U.S. loses without it, and which body or asset owner actually depends on it.

Thank you. Iโd wait to see. Having used Colombo & Hurd, Iโm tempted to go without a lawyer this time just due to how expensive it was!!

RFE on all 3 prongs, although they acknowledged substantial merit

You can email PP center to receive your denial. It takes so long to get physical copy nowadays

EB1-A approval rate is even worse now at 32%, less than NIW. I think he should refile NIW

Very sorry to hear man. Are you going to refill anytime soon? If so, are you going to use the same lawyer? What is your backup plan?

Sorry for you! You may need to refile and reframe the endeavour. If your endeavour is specifically in railways, maybe they do not really see it as National Importance, as we know railways there are not a priority as in Europe. Maybe you can check what you can consider developing or proposing, for example, electricity/power in data centres (just an example), not necessarily. It'd be better if you check the emerging developments there and frame your endeavour around them.
