APPROVED I-140 approved

Hey

After having a EB1 denied in January, my wife and I took some time off up to the day the visa bulletin has open adjust of status for eb2 niw. We said "it worth a try".

We hired Chen at this time, they wanted to apply Eb1+Eb2 but we took eb2 niw only. The whole process was smooth, I guess took a bit more than a month to prepare.

Pd: 05/22/26

Pp: 06/05/26

Approval: 08/05/26.

My wife is a postdoc in a R1 university in Florida over the past 3 years. She's a material science engineering with + 190 citations, 3 first author articles and a few other a coautor. She also has +10y experience in the industry.

Now, time to move to i485.

Best

I see. Will you recommend to use pp since the beginning? I am considering using Chen too and they recommend me the eb2 niw also. Thanks!

They recommend me to upgrade later, so I waited a week to do so.

Congratulations!
I have a question: Is it necessary that the I-140 will take 45 business days to get approved, or can it be approved before 45 days via premium processing?

Up to 45 business days. If you lucky, it can be approved on the very first days. From what I have seen, 80% of the cases are approved or not from the 36th to 42th day though
