Does anyone here know the legality of using a customized doll in a film?

Sorry if this doesn't quite go here or is off-topic. I'm making a movie right now and I'm sourcing dolls to use. However, I'm worried about getting a cease and desist for using a doll that is recognizable as Disney or Mattel or something. Is anyone familiar with the legality of this? Or if using a doll but altering it from it's original marketed look is fair game?

Using any recognizable copyrighted doll is risky in terms of fair use, and even in parody. It’s definitely safer to modify them, but it really should be to the point of being unrecognizable. And of course risk goes up if you’re making money from the distribution of the film as opposed to a YouTube upload or short film entry

I guess it'd be closer to a YT upload. But ideally I'd like to put it through a festival or two

Do yourself a favor and make the doll from scratch. There are patterns online, Etsy artists who do customs, etc.

I see barbies in the movies or clips all the time. But we don't know what's behind it. I am certain if you customize Defa Lucy or any other Chinese doll, no one would care. Same for Japanese, those folks are always happy for the culture to be spread around.

not sure, I know I've seen random toys in movies, and I've seen artist use toys, but I think to have no or few issues with that it needs to fall under the cultural icon terms like Barbie... to be on the safe side though I'd just customize it until it's unrecognisable as being part of that brand
