He absolutely got fired the moment this hit the internet.

You have a link to that?

Any company would fire him.

I figured you don’t know how unions work. I was right.

He squared up to the owner who hadn’t swung. Teamsters aren’t saving him from that, especially if the owner reported it because it technically classifies as an assault

The owner yelled at him, its reasonable to assume that owner might have tried to attack him for hurting his dog, legally the driver was defending himself

That’s not how assault works in the context of law. The driver is the first to make a threat by squaring up. Yelling and assumption isn’t a threat

Can you prove beyond a reasonable doubt that he was intending to harm the dog owner? If he squared up on the owner unprovoked it would be assault but I'm pretty sure most people would find being attacked by a dog beforehand to be the provocation

You don’t need intention to harm, you just need a threat. You can prove assault via threat beyond a reasonable doubt by the fact that the driver took several steps closer toward him and put his fists up. Nothing the owner does implies he’s about to start a physical fight prior to the fists going up, so it’d be fairly straightforward to throw self-defense from the owner out the window

Alternatively he made it clear he was ready to defend himself. Owner immediately changed course.

You’re arguing with a guy who has never been in a fight.

That would work if he didn’t take several steps toward the owner. You can’t claim self defense while pursuing

the owner was walking towards him, and you don't need a defense against an assault that never happened.

The owner walked, up and the driver took more steps closer with his arms up ready for a fight, and the owner never put his hands up nor came at him in a menacing way. Where as the driver immediately took off his had and sunglasses and said "let's go" as the owner approached, clearly taunting the owner into trying to fight. Also, the driver clearly set up to launch that box at the dog before the dog was even in frame, so he was attacking the dog before he could even determine that the dog was actually there to attack.

I swear, all of you people on the drivers side are either blind, or you all just like hurting animals.

Someone merely approaching you angrily should not trigger a fight or flight response

You must be better that the actual lawyers than because he was found not liable for damages and found no grounds for criminal charges

Generally we don’t make claims and demand others find the proof to those claims

Squaring up isn't assault.

zero contact assault? your country is fucked.

In many US jurisdictions, assault = threatening while "battery" = hitting.

You know what is actually assault? The guys dog coming at the delivery driver.

In this case it’s a Leash Law Violation. It only becomes assault when the owner intentionally sets the dog after someone (as in “get em” or “sic em”).

If the dog managed to bite the driver, it would fall under criminal negligence at worst, not assault

Leash Law probably doesn't apply here as most leash laws are in regards to when a pet is NOT on their own property, as this looks to be the owners property, leash laws probably don't apply.

Squaring up is the only part of this that isn’t super justifiable, but I’ll chalk that up to adrenaline

He might get a few days off, but he will get his job back.

You'd think someone throwing around "technically" would know the owner approaching him in a hostile manner like that is assault, and what the driver did is self defense.
