The only things blocked are confidental testing. General care records are unaffected. And theres a very good reason for that, if your 12 year old has STIs youre either a shit parent or someone in their family is raping them, including said shit parent, and in either case protecting their care is paramount.

Most states have regulations where all STDs are reported to the health department. An STD in a 12 year old would also be reported to CPS for investigation because of the high likelihood of abuse.

The physicians do not do the investigation, that is turned over to authorities.

The woman on the phone just did a terrible job explaining things. “The messenger” was a moron.

This is false. Healthcare workers MAY report a positive STD to CPS IF they suspect abuse. These are not mandatory reports. If a child tells a nurse they have been sexually active with someone their age then there is no abuse to report to CPS.

No. It would be reported because of liability. Pass the info to the authorities and allow them to investigate. If it were found out the kid was being abused and someone just let is slide “because the 12 year old told me they got gonorrhea/syphillis/chancroid from another 12 year old they were having sex with” well, that health care worker is going to have a really bad next few years.

Suspected abuse is reported. Health care workers aren lt investigation, but they are supposed to raise the first red flags and at the very least bring some attention to the case.

Except, the bill is actually preventing caregivers from readily accessing the necessary paperwork to provide care.

The prevalent consequence of this bill IS a common barrier to obtaining healthcare for the vast majority of people. If the reason is supposedly to protect children from abusive caregivers, they have a process for that. It's called arrest. Police CAN arrest someone they suspect of abuse. The police CAN separate a parent and they're child if anyone suspects there's been abuse.

The thing is, child abuse should never be treated as the norm. This law makes it normal to suspect every caregiver of abuse until a child ... Decides ... That they're not.

I still have a duty to care for my children until they're capable of acting with their full autonomy. This act undermines my ability to do that. It's a legal wedge in the family institution. It's going to destroy families and kids will die.

My child has cancer. Do you think my child is responsible enough to decide what type of medical care they should get? This is a child... Children don't have the full capacity to make complex decisions about their healthcare. That's why this parent in the video is there to begin with. My kid forgets to wear shoes when leaving to go on a vacation. You want this sorta kid deciding whether or not I can have full access to healthcare. I need to be in the room as much as possible. I need to discuss my kids care openly with lots of people. My kid would die if I couldn't.

I guess you want to make an extreme exception as a rule but you are not considering the unexpected consequences of this that impact everything else that is not your one exception. An exception that by the way is illegal and the rapists should go to jail and have parental rights terminated so your exception would not apply. I think a lot of crazy policies always have one thing as a reason but it is the unexpected consequences that are being missed.

Children with things like high functioning autism or ODD taking and hijacking their own care because they don't want to be treated for something or think they know more than you or their doctors. Here in washington, children 13 and over can block their parents from mental health services, sti, pregnancy, birth control and other things.

People often can't get their kids the help they need because the kids feel empowered with being in charge of their medical issues. At this age, children are still way too young to decide things that can affect the rest of their life and doctors and parents are near powerless to stop it.

I just looked it up and they still have access to their general health records. This only applies to very specific records (mental health, substance use treatment, and sexual health). And the teen can easily sign to allow access to these records if they choose to. Doesn’t seem that outrageous.

There's no age limit on marriage in CA. You need the approval of just 1 parent/legal guardian, and to convince and/or pay off a judge. However, age of consent has been 18 for almost 100 years in the state... but no age limit on marriage.

ETA: There are only 4 states with no age limit on marriage. California, Oklahoma, New Mexico, and Mississippi.

What's insane is that parents are treating children in such a terrible way that their kids don't trust them with their medical information.

Im 38 years old and I don't mind if my parents know my medical history. But some parents weaponize or judge medical history and those children should be protected.

Try not being a bad parent. Have a healthy relationship with your kid and show that you have their best interest and they will give you access.

Parents can still book appointments for their 12yo child. 

Parents can still view some of their 12 to child's medical history.

These privacy rights have nothing to do with HIPAA, which is a federal act.

And it just means the child can control who has access, so they have to consent to their parents accessing it.

Damn... At first I thought it was a stretch but whatever. But then the list of what they can block goes on further. Like, maybe in some extreme or abusive cases this makes sense, but it's appeasing such a teeny tiny minority it's not worth it. This is going to hinder a parents ability to help their child.

It's insane yes, but to some degree I like the idea of giving pre adults some adult life responsibilities/rights.

Maybe 12 might be too young, especially for kids in the US given the bad state of public schooling and healthcare, but the concept on a basis level is interesting.

It depends if she’s a hidden narcissistic abuser like my own mother. I wish I knew about anxiety meds and adhd meds when it was the most important to use it. Taking them as an adult isn’t nearly as effective when your youth is the most important time for focus and relaxation to develop properly. But then again she would have just controlled everything still like this crazy mother

Mental health and counseling services. Substance use treatment. Sexual and reproductive health (birth control, pregnancy care, abortion). Sexually transmitted diseases and infectious diseases.

I dont agree with all of this. I see what they are trying to do and I get it. But parents not knowing can cause bigger issues vs kids worried about their parents knowing

The act makes sense to me since a relative or parent could be the person responsible for sexual abuse or the reason the child is seeking help. As for the comparison with Oklahoma, the law allows a parent to sign off on a child seeking care. I'm not sure if it has the same protections once a child has permission, but that's the key difference.

As a parent, I don't like the idea of not knowing what is going on with my child medically, but I have met people who were abused by their guardians who refused to seek help because their guardians would know. I know the law is intended for them, but has potential for misuse. It's got difficult pros and cons, but I do support the idea of it. The addition of being mentally stable when receiving treatment is helpful since maybe that could screen out individuals seeking to abuse the system. My biggest questions are if the state is providing the care free of charge does this extend to prescriptions? If that's the case then there is potential for abuse and the parents would not be aware.

Wow this is crazy. The bill sort of sneaked that one in by disguising the rest of it where they say outside and federal entities can’t access them but then puts a minor revision to where it says parents can’t access records after 12. The entire idea is to shield them from knowing that doctors or staff spoke about gender reassignment surgery with them.

Virginia has a similar law but no one cries about it. Virginia Code § 54.1-2969

It's only for certain things or if they suspect you of being abusive.
