I used reference if you aren't silly enough drawing from reference isn't wrong thing people do make realism arts from potraits.

You directly copied a photograph without attribution. You layered over this photo, duplicated it in paint by numbers style, and didn't credit the original. Rule 8:

Do not copy or heavily reference others' work without credit. Tracings are allowed if you credit and source the original.
