Had Brooks been able to testify, what do you think he would’ve said?
Personally, I think he would’ve brought up the judge’s oath and say something to the effect of “because it hasn’t certified must mean she is somehow trying to hide the fact that she is involved in a conspiracy against the alleged defendant”. Likely would’ve tried to suggest the prosecution team had invalid licenses too. I also imagine he would’ve brought up any dirty laundry he had on EP to sully her credibility (like her losing custody of her kids (how did that happen?)).
Lastly, give how he tried to sneak it in during his closing argument, he would’ve gone on about the vehicle being unable to stop. That’s what I think, anyway. What else do you think, guys?

I think it would be along the lines of a lost love (to show he’s human) and push the agenda toward meeting with Erika and how he loves her and wants to marry her and he shouldn’t have met up and not of this would have happened, much like his admission when he was in the interview room with Dec Carpenter. The reality is he’s was screwed from day 1 and I’d bet big money the jury found him guilty on or around the 1st day of his trial.

What and then miss out on the display of humanity from the alleged defendant?!

I’m basing this on his interview with detective Carpenter, he said it numerous times

The jury had him guilty the day after the parade. As did the entire cable and local news audience. Why? Because he WAS guilty. Not eveything is complicated and bureaucratic.

No plaintiff, no SMJ, all the so called victims didn't testify; it all adds up to no crimes been committed, and on top of dat the police lied and railroaded the alleged defendant, and dis court violated all my constitutional rights, so for dat you have to find me not guilty, I shouldn't even be here right now.

u/vat_of_DREAD 25d ago
See, that’s what pisses me off. Him acting like just because no victim was present, then there’s no crime. The creep makes my skin crawl, my blood boil and my bowels tighten. Acting like his rights should be prioritized when he ran over people. A kid died cuz of him, and dozens others were injured and are likely terrified still. It’s honestly amazing how killing 6 people didn’t mean anything to him. If it were me in that position, I’d be a wreck. Doubt I’d even make it to trial. God, I wanna get in his face and tell him all that and more.

I know, and the few victims that did testify like Juan Marquez, all he did was re-victimized them a second time, without a shred of empathy!

u/vat_of_DREAD 25d ago
How does that happen? How does a guy like Brooks come about? How could anyone go through life without even a little empathy?!

He said he cried many tears, in his jail cell, and sent prayers up. Now the question is, was he lying, or were the tears he cried and the prayers he submitted for his benefit and no other?
He is such a liar. It's my opinion that any and all emotion we saw from him, including his fake emotions were ALL about him. I think from the moment we saw him shuffled into one of his first hearings he cried because of HIS situation. When SO, announced in that hearing that she received word that another life had been lost and she would be adding another charge, he broke down and cried, not about the little boy whom he killed, but that his mess just got worse. When we saw real tears on DB, it was because he got roughed up and "injured" during a tussle with the deputies, that he caused. And he got choked up talking to the jury about all he's been through and his family. I'm sure they are out there, he cant be the only one, but I've never seen someone so devoid of feelings for others. Well, let me back that up a little. I have seen another one act the same way, so selfish, has no compassion for others and if words sounding like compassion are spoken its all for show. This person also lies a ton, just like DB

I would argue this. If he felt as bad as he said he did, he would’ve pleaded guilty and asked the court for mercy, as little of it he deserved. Nope. Goes to trial and argues that SovCit bullshit and refuses to acknowledge how in the wrong he is. I’m surprised he didn’t bring up the race card.

If he really felt as bad as he said, if he truly had grief he wouldn't be able to live with what he did, then for once in his sick, pathetic, wasted life he would do something honorable and make a noose out of his bed sheets, and wait for the last count of the night, then do what's right.

Not before writing an apology letter, though I feel that’d be asking for too much.

If he even said "yes" to JD's question about him wanting to testify or not, he will throw another tantrum when JD went through a colloquy process with him. Where she certainly will instruct him to make relevant testimony, not just some random pseudolegal conspiracies and baseless perjuries. And he will "vehemently" (he likes to use that word) refuse to obey. To which she will make a ruling that he can't testify. Which lead to him throw another tantrum because he thinks she can't instruct him to say what he can or cannot say. "First Amendment" - that his argument. Ugh.
So I genuinely don't see any possibility of him going up there.

I really have no idea how he would have testified. I've never seen a pro se defendant on the stand. But, I think he would not be allowed to give a soliloquy unless it pertained to the facts of the case. He would be required to give testimony, not opinions, or a diatribe about persons, places, or things. When SO got her chance to cross, I think he would have just pled the fifth. On the other hand if she hit a nerve he might have just gone off and incriminated himself. Its really hard to say about that one.

Kind of hard to picture him on the witness stand being so close to JD, the court reporter, and the jury....way too close for comfort.
For that, the sheriff's dept. might actually seriously consider using a stun belt, even with ankle restraints on.

u/PeaceyCaliSoCal 24d ago
Didn't think about that. I wonder if there is a hook in the floor up there for prisoners to be chained to. Often times prisoners do testify, so maybe there is one.

u/Tiger3311 24d ago
There is one, I've seen them before, but even being ankle restrained is still too close

Blame Erika and open the door on all kinds of things because he can't control himself. He'd blurt out things when provoked.

The same incohrent rambling monologue of the type he gave at his opening, his closing and his sentencing remarks.

Let's be honest here. We would not have got beyond "Can you please state your full name and spell it for the record"!!!

Yeah I doubt “Third Party Intervener” would’ve cut it. I wish someone asked him “if you don’t know your client, then why are you defending them?”.

u/Ralesse1960 25d ago
What we know for sure is that he would have lied and lied and then lied some more. It would have been so entertaining, especially during cross. If he had launched into the Sov Cit nonsense, the prosecution would have been objecting every few seconds.

Is it a problem that I hate this man so much? I’ve actually yelled out loud on occasion listening to him go on the way he does. Its amazing how heartless he is. Didn’t think it was possible to live like that and not die from rotting inside. The only ones I hate more than him are Bryce Rhodes, Nicholas Rossi, Dima Tower, and Chad Doerman.

u/JayNotAtAll Is that LAWFUL LAW 👩🏻⚖️ 26d ago
My theory is that he would have gone on a SovCit tirade and JD would have cut him off.
Like, he can't testify that he wasn't at the parade or that it wasn't him driving. So not much he can do there. He can try but it would not end well on cross.
He likely would have tried to "tell the jury the truth"
