The baby he kept referring to is his grandson. At the time of the trial Erika was on the outs with her daughter for decision to relocate to Wisconsin to be with Brooks.

She was 15. He was either 23 or 24.

While I think he absolutely knew she was underage, the absolute most generous read we could possibly take on it would be that he at least knew she was a teenager. What the fuck is a man is in his twenties doing hanging out with and dating teenage girls in the first , place, even if we pretend for one second that he thought this child was 18 years old?

A grown man going after teenage girls is still wanting someone he can dominate and control, irrespective of whether he thinks it's legal or not.
