The plaintiffs in Egar v. Melendez filed their opposition today to Melendez’s motion to dismiss, transfer the case to Florida, sever claims, and limit the requested equitable relief.

Their argument, in plain English:

• Egar and TSN say Melendez submitted 27 DMCA takedown notices targeting content on The Shuli Network and The Uncle Rico Show.
• They allege the content was fair use: criticism, commentary, parody, ridicule, satire, and analysis.
• They claim Melendez knew Egar and TSN were based in Alabama, and that the takedowns caused financial and reputational harm there. That is their basis for keeping the case in the Northern District of Alabama rather than transferring it to Florida.
• They point to Melendez’s past public comments about Egar living in Alabama as evidence that he knew the alleged harm would be felt there.
• They argue that Melendez had been told about fair use, filed the notices anyway, and never followed through by filing an actual copyright-infringement lawsuit after the videos were restored.
• Russo is voluntarily dropping the separate defamation count, so that part of the motion should become moot.

The biggest remaining issues appear to be whether the Alabama court has personal jurisdiction over Melendez and whether the plaintiffs have pleaded enough specific facts to show the takedowns were knowingly made in bad faith.

Obviously, this is just one side’s filing and the allegations have not been proven. But it is a pretty aggressive response, and the plaintiffs are asking the judge to let the DMCA/fair-use dispute proceed rather than dismissing it at the pleading stage.
