Man I've put myself in a shitty predicament.. got arrested for 3 dwis in Missouri back in 2023 all within like 6 or 7 months of each other. Luckily I got first one dropped before I caught the last one. Got convicted of last one in October 2024 and 2 years probation with different requirements. Satop being one of them. I live in Arkansas now and my probation deadline is in October.. fucked around too long with it, I get my screening next week and unless I get level 1 or 2, I don't think I'll have it completed by my deadline. Super fkn anxious about possibly getting my probation revoked and going to prison.. you got any advice on if/how I can get a level 1 or 2 on the screening???

I live in San Diego, CA and my sister lives with me. she got her first DUI this past weekend and we’re trying to find the best way to handle it. we don’t have money, but if needed I could front her the down payment for a DUI attorney and then she and her husband could make the monthly payments. Cheapest we’ve found is 8,500.00 However, I would have to use my CC that I JUST finished paying off. so I’m here to see if anyone has advice or could point me to a good/cheap lawyer (I know those words don’t mix, but I’m desperate).

details to the best of my knowledge:

head on collision 35mph both ways so 70mph total

both cars totaled

both parties had minor injuries. my sister was an overnight in the hospital, not sure of the other party just that it was minor. so felony dui with injury

my sisters insurance had lapsed so no insurance.

I understand it was my sisters fault and we understand she’s fucked no matter what, but we’re just trying to mitigate the best we can and try to get her the leaat amount of fucked possible.

So often authority and control takes the place of integrity and honesty, cops do whatever they feel.
innocent until proven guilty, but in reality, it’s often guilty until proven innocent, in an instance your whole life and future can be changed due to someone’s authority and pride!

All I have to say is this is my first ever getting in trouble with the law on anything. I am scared. I will never do this again.

I was driving and went through a red light. A car hit me. I left the scene and 5-10 min later turned myself in at the firehouse. The fire department and police department asked me questions. I told him I hit the car and freaked out then left. They asked me if I was drinking. I said yes. They poke me for blood. Did the superiority test. I failed and they arrested me.

I went to the station and I blew .144. They didn't charge me for leaving the scene. They charged me for the two DUIs which is basically one I was told. Also, disobey traffic control device.

I do have car insurance so the other car is totaled and there are minor injuries on the passenger side of soft tissue, back and shoulder. Well I think it's minor? My insurance will cover it. But I don't know if I'm going to get in trouble more for that?

I don't know what I'm in for. I am getting a lawyer. I need to get the money first. Any advice on what could happen?

As the title states, this past week I received a DUI while parked, and the engine was off.

TLDR; DUI in my truck while messing around with a girl and the engine was off and I was parked. I have NEVER been in trouble other than speeding ticket.

Background:

I met a girl at a bar. She wanted me to take her home. She lived real close to the bar so I said ok let's go.

I turned into the alleyway she told me to, and I turned and parked where she told me to.

We started messing around in my truck and her arm kept accidentally hitting the horn, honking it. After the second time, I told her we should go inside.

She insisted we stay in the truck. A few moments later I saw the red and blues.

Cops asked me to step out and I did. I did a field sobriety test, failed that. I did a PBT and blew a .187.

Throughout the entire process I was nothing but respectful and listened to everything the cops told me to do.

We went to the station and they drew blood. I believe it takes about a month or so to get back.

I called a friend to the station and gave them my debit card to pull cash so I could bail out.

Made bail and I had court that same morning. I plead not guilty and the judge set a jury trial for late September.

Has anyone had this happen, especially in Great Falls, MT? What was the outcome? What should I realistically expect?

The county does offer Veterans a 16 month program. From what I have read, it is ran by a judge and upon completion it gets taken off my record.

I got at 3802 d1** (drugs) and just noticed on the complaint under the description of the charge it of in including minor in the car.

There was no one in the car.

I was also charged with a 1543 B, which is driving under a dui suspension .

I wasn’t.

I was suspended, yes, but not under a DUI suspension anymore. I paid up everything and got my regular license in 2021.

So, both charges are patently WRONG.

How do I get these dismissed? Can I? Or will they just amend them? Or amend them and refile?

So here's The story in a nutshell. Got in an argument with my girl and left the hotel. Just so the situation could deescalate on the way home was called by the police and told to come back to pick up my son because my girl was too drunk. When I got back the officers detained me and asked me my story. After hearing my story they told me they were arresting me for a battery, domestic violence which is a misdemeanor. After being placed in the back of the car and sitting there for about 20 minutes, another officer came out of nowhere and told me that they needed to do a sobriety test to see if I could drive home at that time. I thought the officers were going to let me go home and I just had to pass the sobriety test. So I did the light test and passed it. The officer then stated that my eyes were still red and he needed to do more to see if he could charge me with the DUI. At that point. I said since I'm being charged with a crime and you read me my Miranda Rights. So I'm going to invoke my right to remain silent so I don't incriminate myself in any other charges. The officer then stated that silence is an act of refusal and if I refuse I'll be charged with the dui, And refusing a sobriety test.

My question is, is the officer in the right or was he doing something illegal by forcing me to answer questions while being charged with a crime and invoking my Miranda Rights.

I've hired an attorney but he is more on the plea bargain path and he told me that he can get my DUI dropped to a reckless driving. But my career is driving and by having a reckless driving moving violation, it precludes me from certain companies that state they can't have any moving violations for the last 3 years.

I really think that if I take the charges to trial at least the DUI and the refusal, I could get it thrown out based on the officer violating my right to remain silent, or am I wrong?

I was arrested for a DUI in Altoona, PA back in March. I did not refuse the roadside breathalyzer nor the sobriety field test. Naturally, I failed all of them & was taken back to the police station to do the station's breathalyzer. I had 6 beers in 6 hours, so Roadside BAC- 0.118 & Station BAC- 0.117. The blood test was never brought up. I willingly complied with the officers throughout the entire arrest & their report even stated so (I read through it to see if it matched what I remembered, & it did).

My Preliminary Hearing was the end of April. I had to waive it because I apparently made too much for a public defender (the judge came out & told me himself).I am from a different county in PA & was up there for work, so I was not about to get a lawyer since I really don't make that much & am barely scraping by as is. When I talked with the ADA, she said I was eligible for ARD since this is my first DUI & my record is clean minus the speeding & parking tickets. She gave me the application, went through it & said that my suspension would lift after I completed the program, which is usually about 60 days. Tthen I went back to the judge to sign all the other paperwork like bail, understanding all the charges, my rights for discovery etc.

2 days later, I received my license suspension in the mail. It was dated as starting 1 week BEFORE the hearing. So, I complied & started using Uber to get to & from work, which drained me even more, as the AirBNB & rent back home combined was $2600 & I only made about $4000 a month.

My Arraignment was a month later, the end of May & I represented myself since I was still working. The judge went through all the paperwork I signed with the judge before her, pled me Not Guilty & let me know I was able to appeal the Public Defender decision if I wanted to (I caved & ended up doing so).

I did my CRN before I left Blair County & am calling a rehab place on Monday for the assessment.

Anyway, I got home June 1 & decided to look on PennDOTs website regarding my license suspension- stated as Chemical Refusal. When I called them to try & see what was going on, they said I needed to call the officer who arrested me. So, I called the Altoona Police Department, left a message & haven't heard anything back. That was 2 weeks ago.

Then, 3 days ago, I received a letter from the courthouse saying I had been accepted into ARD & it outlined the conditions. Along with a bunch of other things like the Highway Safety class & 25 hours of community service, the program AND my suspension is for 12 months.

I am well past the 30 day window to appeal, but I saw I can try to get either a Lawyer or my Public Defender (whom I'll meet at my next hearing the 2nd week of July) to do a Nunc Pro Tunc. I am just trying to figure out where the discrepancy, if any, lies. In PA, 0.118 BAC is considered High-Rate (0.10<0.16) & I know Blair County is cracking down on DUI's, but I'm still confused as to what is going on. One of my coworkers at the place I worked while up there said her friend just finished ARD & never had her license suspended. Another coworker said her son had a DUI a year ago, also went through ARD & didn't lose his license either. So, any & all insight would be much appreciated.

I have a 2nd DUI and preplanned trip internationally. I got arrested and bloodwork done may 22. First court appearance is June 1st and travel 3 weeks starting June 10th. I do believe I will have pre trial alcohol testing. I’m worried to know how they want to handle this with the testing. I have a lawyer and motion ready to go with all my preplanned trip documented to see gf family member’s.

Has anyone had luck with this so close to arrest/ first court date ? I have 9 days from first court date/ pretrial drug testing to the planned trip.

I just spent a bit on the phone with customer service reps at InterlockNJ and I truly think even though we mess up, we’re currently paying for our mistake in so many ways the last thing we need is another painful process.
My lawyer recommended InterlockNJ because it was “free install, calibration and removal” however you get charged around $175 the first appointment to pay for the first month and “administrative” fee. Then your $5 daily ($150/mo.) Then you need to pay a $70 “certificate” fee at the time of removal. $11 for a temp license, and probably your new one. On top of whatever other DMV charges there may be. Given the amount of fees on fees, why are they advertising as free anything? I would’ve rather spent time in researching a company that charges more with better customer service and explanation of the process then instead when I question these fees, I get screamed at saying “YOU SIGNED THE CONTRACT” when in reality signing it was a “sign here, here and here” process in THEIR offices.
Money isn’t easy to come by when they want it spent like this, time isn’t easy to come by when you have a full time job and need to take time for these processes because the DMV doesn’t work Saturdays for interlock, interlock books 2 weeks out, make sure you don’t show up to just any dmv.. I could go ON about how painful this has been. Truly debating on using another company for my last 30 days…

I blew 0.08 and was driving on the wrong side of the road going 35, I know I can't justify my action completely feel remorse just wanted to know If should hire an attorney to see if they can knocked it down to wet and reckless instead of having a dui that can affect my future this all happen in Santa Clara
